GLEDHILL <br />E-MAIL: ggledhill@cghp-law.com <br />ltE: Senate Bill 1925; UNC Board of Governors Authority to create an Airport <br />Authority <br />Dear Board Members: <br />During its last session the North Carolina General Assembly ratified S 1925. Senate Bill <br />1925, in pertinent part, amended N.C. Gen. Stat. § 116-11 (powers and duties ,generally of the <br />UNC Board of Governors) to authorize the UNC Board of Governors to create an airport <br />authority. to support the missions of the University of North Cazolii~a at Chapel Hill and/or the <br />University of North Cazolina Health Care System. Senate Bill 1925 also created new Article 33 <br />of Chapter 116 of the General Statutes detailing the powers of an airport authority created by the <br />UNC Board of Governors. The Governor signed S 1925 into law on August 8, 2008. Copies of <br />pertinent provisions of S 1925 are enclosed. <br />Senate Bill 1925 makes an airport authority created pursuant to it a political subdivision <br />of the State of North Carolina with the county in which the airport is established its "territorial <br />jurisdiction." As originally drafted, S 1925 would have authorized an airport established pursuant <br />to it to be located in any one or more than one of the counties of North Carolina. As amended, <br />late in the legislative session, the airport authority created by the UNC Board of Governors may <br />only be established in Orange County and the sole purpose of the authority is "to re-site Horace <br />Williams Airport and operate the re-sited airport." <br />In a letter dated August 12, 2008 from UNC Chancellor H. Holden Thorp to <br />Commissioner Jacobs, Orange County was informed the University was proceeding with a plan <br />for an airport "in support of the missions of Carolina and the UNC Health Caze System." In a <br />follow-up letter dated October 5, 2008 from Chancellor Thorp to Commissioner Jacobs, <br />Chancellor Thorp asks the Board of Commissioners to "identify [its airport authority] <br />representatives."
