MINUTES OF THE ORANGE COUNTY 193 <br />BOARD OF COMMISSIONERS <br />April 9, 1969 <br />The Orange County Board of Commissioners for the County of Orange, net in <br />adjourned session in the Community Room at the Orange Savings & Loan Association <br />in Chapel Hill, North Carolina on Wednesday, April 9, 1969 at 8:00 o'clock P.M. <br />Members Present: Vice Chairman Walker and Commissioners Harvey D. Bennett, <br />William C. Ray and Ira A. Ward. <br />Members Absent: Chairman Carl M. Smith. <br />Vice Chairman Walker presided over the meeting in the absence of Chairman <br />Smith. <br />R. B. Peck, City Manager; Town of Chapel Hill; E. H. Denny, Attorney for <br />the Town of Chapel Hill; and Adger Wilson, member of the Planning Board for <br />Chapel Hill, were present. <br />This meeting was held for the purpose of discussing the proposed legislation <br />entitled "Ex-Territorial Zoning and Subdivision Jurisdiction of the Towns of <br />Chapel Hill and Carrboro". <br />Mr. Denny explained that the proposed legislation was divided into two <br />parts with Section I dealing with an actual extension of the zoning jurisdiction <br />of the towns of Carrboro and Chapel Hill and with Section II concerning the <br />relationship between the towns of Carrboro and Chapel Hill as to zoning matters <br />and zoning procedures. The Town Manager and The Town Attorney urged the Board of <br />Commissioners to consider Section II separate and apart from Section I as Section <br />II was written in order to provide the machinery for a smooth working zoning <br />relationship between the two towns. They stated that Section II should be of <br />little concern and would cause no problems for the County Planning Board. <br />Discussion ensued. The Board of Commissioners took no action on the matter. <br />The County Administrator recommended that the Board of Commissioners pass <br />a resolution which would allow the Orange-Person Mental Health Center Employees, <br />to become a member of the Local Governmental Employees, Retirement System. <br />Upon motion of Commissioner Bennett, seconded by Commissioner Ray, the <br />following resolution was unanimously adopted: <br />RESOLUTION ENLISTING IN <br />NORTH CAROLINA LOCAL GOVERNMENTAL EMPLOYEES' RETIREMENT SYSTEM <br />WHEREAS, the 1945 General Assembly amended the North Carolina Local Governmental <br />Employees, Retirement System so as to make the benefits of said System available <br />to all counties, cities, and towns, and <br />WHEREAS, the governing body of this Unit realizes the necessity of providing <br />its employees with the security and protection provided by a sound retirement <br />plan, and <br />WHEREAS, Article 3 of Chapter 128 of the General Statutes of North Carolina <br />provides that any governmental unit desiring to enroll its employees in said <br />System shall make application to the Hoard of Trustees of the North Carolina Local <br />Governmental Employees' Retirement System and shall by resolution elect to <br />participate in said System. <br />NOW, THEREFORE, be it resolved by the ORANGE COUNTY BCARD OF COMMISSIONERS <br />in special session, <br />1. That the ORANGE COUNTY BOARD OF COMMISSIONERS hereby elects to participate <br />the employees of the ORANGE PERSON MENTAL HEALTH CENTER in the North <br />Carolina Local Governmental Employeest Retirement System. <br />2. That the ORANGE COUNTY BOARD OF COMMISSIONERS hereby agrees to comply <br />with all provisions of the North Carolina Local Governmental Employees' <br />Retirement System as defined in Article 3, Chapter 128 of the General <br />Statutes of North Carolina as amended by the 1945 General Assembly. <br />3. That the DIRECTOR, ORANGE PERSON MENTAL HEALTH CENTER is hereby ordered <br />and directed to make application to the Board of Trustees of the North <br />Carolina Local Governmental Employees, Retirement System for enrollment <br />of this Unit and its employees in said System. <br />The following number voted in the affirmative: 4 <br />The following number voted in the negative: 0
