B11K FnE 114 MINUTES OF THE ORANGE COUNTY <br />BOARD OF COMMISSIONERS <br />May 9, 1968 <br />The Board of Commissioners for the County of Orange, North Carolina, pursuant <br />to adjournment, met at 8:00 o'clock P.M., Thursday, May 9, 1968, at the home of <br />George Spransy, Dogwood Acres, Orange County, North Carolina. <br />Members Present: Harvey D. Bennett, Chairman, and Commissioners William <br />0. Ray and Ira A. Ward. <br />Members Absent: Henry S. Walker and Carl M. Smith. <br />Also present: Charles Rundgren and M. 0. Caton representing the North Carolina <br />State Board of Health. <br />At the hour of 8:00 o'clock P.M., the Chairman announced that, pursuant to a <br />notice duly posted and published, this was the date and hour fixed by the Board of <br />Commissioners and the State Health Director of the North Carolina State Board of <br />Health for the joint public hearing upon a petition filed with the Board of Commissioners <br />for the County of Orange on April 1, 1968 proposing the creation of a sanitary district <br />in Orange County. <br />The Chairman announced that the Board of Commissioners and the representative <br />of the State Board of Health would immediately hear any and all resident freeholders <br />within the proposed sanitary district, all non-resident freeholders owning property <br />within the proposed sanitary district and any any other interested person concerning <br />the creation of the proposed sanitary district. <br />Chairman Bennett introduced Mr. M. 0. Caton and Mr. Charles Rundgren, representatives <br />of the State Board of Health, to the audience and turned the chair over to Mr. Caton. <br />M^. Caton then requested Mr. Rundgren to read the Notice of Public Hearing and legal <br />description of the proposed district. This having been done Mr. Caton then asked if <br />anyone present desired to speak against the creation of the proposed district. <br />Mr. Lester Coehen, representing.Southeastern Water Utilities, read a statement <br />opposing creation of the district and advised Mr. Caton he would file a copy of this <br />statement with the Board within 48 hours. <br />One other unidentified person spoke in opposition to the creation of the district. <br />Following this approximately ten persons spoke in favor of the creation of the <br />district. <br />At the conclusion those'preeent indicated by a show of hands that approximately <br />35 persons favored creation of the district and two persons opposed the creation of <br />the district. <br />Thereupon Commissioner Ward introduced the following resolution which was read: <br />RESOLUTION CONCERNING CREATION OF A <br />SANITARY DISTRICT IN ORANGE COUNTY <br />WHEREAS, a petition proposing the creation of a sanitary district in Orange <br />County was filed with the Board of Commissioners on April 1, 1968, which petition <br />is set fdrth in the minutes of the April 1, 1968 meeting of said Board, now therefore, <br />BE IT RESOLVED by the Board of Commissioners for the County of Orange: <br />Section 1. That the Board of Commissioners deems it advisable to comply with the <br />request of said petition for the creation of a sanitary district in Orange County and <br />does hereby determine that the territory described in said petition should be created <br />and established as a sanitary district pursuant to Article 12 of Chapter 130 of the <br />General Statutes of North Carolina for the purposes stated therein. <br />Section 2. That the Clerk of the Board of Commissioners is hereby directed to <br />certify immediately a copy of this resolution to the State Health Director of the <br />North Carolina State Board of Health. <br />Commissioner Ward moved the passage of the foregoing resolution entitled: <br />"RESOLUTION CONCERNING CREATION OF A SANITARY DISTRICT IN ORANGE COUNTY" and <br />Commissioner Ray seconded the motion and the resolution was passed by the following <br />vote: <br />Ayes: Commissioners Ward, Ray and Bennett. <br />Noes: None ?I <br />There being no further business to come before the Board the meeting was adjourned <br />to meet again on Monday, May 13, 1966. <br />Harvey D.
