The Orange County Board of Commissioners met in regular session on Monday, <br />June 6, 1966, at ten o'clock a.m. in the Commissioners Room at the courthouse in <br />Hillsborough, North Carolina. <br />Members present: Chairman Harvey D. Bennett, Commissioners Villiam C. Ray, <br />Henry S. Walker and Gordon Cleveland. <br />Members absent: Commissioner Carl M. Smith. <br />The minutes of the previous meetings were read by the Clerk and approved by the <br />Board. <br />Ed Barnes, County Farm Agent, and Dr. W. G. Andrews of the Farm Extention <br />Department in Raleigh, were present. They informed the Board that Larry Byrd, <br />present Assistant Farm Agent, was resigning and that they were presenting the name of <br />Eugene Jackson as the replacement for Mr. Byrd. Dr. Andrews stated that in order to <br />hire Mr. Jackson the Farm Extention Department was recommending that the salary of <br />the Assistant Farm Agent be increased. This would mean that the county's share which <br />presently is $1,725.00 would be increased to $2,500.00. No action was taken on said <br />request. <br />Chairman Bennett presented a letter and resolution from C. M. Crabtree, Chairman <br />Co-ordinating Committee of Orange County and Alamance County Funeral Directors. said <br />letter and resolution stated the declaration of intent which was adopted by all of <br />the funeral directors of Orange County and Alamance County at a meeting held in <br />Greensboro on May 31, 1966 to terminate not later than September 30, 1966, all <br />ambulance service in Orange County and Alamance County. Discussion ensued concerning <br />said resolution of intent. <br />A. H. Graham, County Attorney, presented the following Fire Protection Contract <br />for approval. <br />NORTH CAROLINA <br />ORANGE COUNTY <br />FIRE PROTECTION CONTRACT <br />',THIS CONTRACT, made this 6 day of June, 1966, by and between Orange County, a <br />body corporate (hereinafter called "County"), and the Town of Chapel Hill, a North <br />Carolina municipal corporation (hereinafter called "Town"): <br />WITNESSETH• <br />THAT, for in consideration of the mutual undertakings herein contained, and <br />subject to the terms and conditions hereinafter set forth, Town hereby agrees to <br />furnish, from July 1, 1966 to June 30, 1971, fire protection to residenbs of and <br />property lying within Colony Woods Subdivision, sections I and II and any other areas <br />to which County and Town hereafter agree to extend the protection given under this <br />contract in accordance with the General Statutes of North Carolina (hereinafter called <br />"the protected area"). This contract may be terminated by either party as of the end <br />of any fiscal year by the giving of thirty days written notice to the other party <br />prior to the end of the fiscal year. <br />1. Nature of Protection. The Town shall to the best of its ability furnish such fire <br />fighting equipment and personnel as the Town deems necessary for the purpose of fire <br />protection to property and persons located within the protected area. From the <br />moment any of the fire personnel of Town arrives within the protected area in response <br />to a call, such person as is in command of the detail shall assume absolute command <br />of all activity being carried on on property on which there is a fire and all persons <br />on that property shall be subject to his absolute direction and control. Such fire <br />personnel shall have sole discretion as to the manner in which such fires as may exist <br />are combated and what men and equipment are to be committed thereto. Town shall, <br />through its Fire Department, exert its best efforts under the circumstances in com- <br />bating said fires but shall in no way be liable for its failure or lack of success in <br />connection therewith or for damages done to property of residents of the protected <br />area, or to that of their agents, servants, employees, licensees, or invitees by virtu <br />of or arising out of the same. All obligations of Town to respond to calls hereunder <br />shall be secondary and subordinate to Town's duties to furnish protection to the <br />residents and property owners of Town. <br />2. Com eennsRation: For furnishing fire protection to the rotected area, County hereby <br />agrees to pay annually to Town a sum equal to ten cents ( .10) on the one hundred <br />dollars ($100.00) valuation of property having a taxable situs within the protected <br />area on January 1 preceding the beginning of each fiscal year during which this <br />contract is to be effective. Said annual payment shall be made by County to Town on <br />or before the 31st day of December of each and every year, beginning in <br />Calendar Year 1966. <br />In witness whereof the parties hereto have caused this instrument to be executed <br />in their respective names by their duly authorized officers and agents, this 6th <br />day of June, 1966." <br />Upon motion of Commissioner Cleveland, seconded by Commissioner Walker, it was <br />moved and unanimously adopted that, the Chairman of the Board and the Clerk to the <br />Board be authorized to sign the Fire Protection Contract for the County.
