J <br /> �1Qnn �n <br /> NORTH CAROLINA <br /> ORANGE COUNTY <br /> FIRST AMENDMENT TO AGREEMENT FOR PROVIDING LIMITED TECHNICAL SERVICES AND <br /> ASSISTANCE TO ORANGE COUNTY BY THE CITY OF MEBANE FOR THE MAINTENANCE OF THE <br /> COUNTY'S EFLAND/CHEEKS WASTEWATER SYSTEM ("AGREEMENT") <br /> This First Amendment("First Amendment")to Agreement is made as of the 2"d day of May,2017, <br /> by and between ORANGE COUNTY, a county of North Carolina ("COUNTY") and THE CITY OF MEBANE, a <br /> public body politic and corporate, organized and existing under the provisions of Chapter 160A of the <br /> North Carolina General Statutes,with its principal office in Mebane, North Carolina "(CITY"). <br /> RECITALS: <br /> A. The parties entered into the Agreement on April 29, 2016, which Agreement is referred to <br /> and incorporated by reference. <br /> B. The parties desire to amend the Agreement to provide for the responsibility of the Operator <br /> in Charge as defined in North Carolina General Statutes Chapter 90A, Article 3, to be the <br /> responsibility of CITY. <br /> Now, therefore, in consideration of the mutual covenants and conditions hereof and other <br /> valuable consideration, the receipt and sufficiency of which is hereby acknowledged COUNTY and CITY <br /> hereby agree as follows: <br /> 1. OPERATOR IN CHARGE. From and after the effective date of this First Amendment, the <br /> operator in charge for the water collection control facility and system shall be a person <br /> designated by CITY,which responsibility and obligation CITY hereby assumes. At the present <br /> time,the CITY designates its present Public Works Director as the Operator in Charge,Wayne <br /> Pore. (The Water Pollution Control System Operator Designation Form (WPCSOCC) is <br /> attached hereto as Exhibit"A"which is incorporated by reference.) <br /> 2. FUTURE CHANGES IN THE POSITION OF OPERATOR IN CHARGE. The parties agree that the <br /> CITY may change the designated Operator in Charge prospectively in its sole and absolute <br /> discretion without notice or approval from the COUNTY. Notwithstanding the foregoing,CITY <br /> agrees to advise COUNTY in writing of any such change in the designated Operator in Charge. <br /> CITY agrees that any person so designated will be duly qualified and/or licensed as required <br /> by the State of North Carolina. <br /> 3. RATICIFICATION OF PRIOR AGREEMENT.
