~_ ~~`1 r-"", ~ ~ Gam"' _. _. __ _.__.`-~ 1 NORTH CAROLINA ~ ~ ~ ~! ; '' ! ~. ~1 ORANGE COUNTY ,_ ._____._....___ _ ____.._ .._.___._.____ This AGREEMENT, made and entered into this the 21'` day of lone, 1999, by and between Orange County (hereinaRer referred to as "County") and the Town of Hillsborough (hereinafter referred to as "Town"), to provide for periodic ftrc safety inspections of facilities within Town's jurisdiction as mandated by the State of North Cazolina pursuant to the authority contained in Article 128 of Chapter 153A and Article 20 of Chapter 160A of the North Carolina General Statutes. WHEREAS, an agreement was made and entered into as of the 1" day of November, 1993, by and between the County aa-d the Town, whereby the County pcrforincd State mandated f rC inspections of facilities within the jurisdiction of the Town, and WHEREAS, the Town has assumed the duties of performing fire inspections of the !revel One facilities within the jurisdiction of the Town, and requires assistance and training for Level Two and Level Three fire safety inspections. which is for approximately R9 (eighty nine) facilities, NOW THEREFORE, for and in consideration of the mutual terms and agreements hereinafter sei forth, the County and tho Town do agree ~ follows: I. County will carry out, or cause to be carried out, within Town's .jurisdiction the minitxtum schedule of inspections required to be performed by local governments puusuant to Section 107, Volume V of the North Carolina Fire Prevention Code, for Level Twa and Level Three subject facilities, The Town's T,evel One CertiEed Inspector snail perform inspections for Level One facilities. 2. Appropriate officials of the County and "1-own shall continue to work together to produce a schedule that identifies buildings, structures, and premises which are of priority fot' inspections within Town's.jurisdiction, 3. County Fire Marshal will submit within five working days of the end of each month a copy of osch fire safety i»speetion pcrfomted within Towsi's jurisdiction during that month to the Towrt'S Code Enforcement Officer. 4. County Finance Office will invoice Town monthly for all inspections performed by the County daring the prior month. Town will reimburse County for cost of a1i inspections performed by County, except as rrwidtd below, within ten workins days of invoice in accordance with the current fee schedule adopted by the Board of County Commissioners. Source of payment and method for billing for inspections under this agreement shall be at Town's discretion and shall, in n~ Way, bC ur bcx;ome a responsibility of County. ~ ., ~, 5. County will inspect all public school facilities within County's and Town's jurisdictions and aii facilities ovmed by County or licensed by the Department of Social Services as care facilities within Town's jurisdiction. County shall not invoice Town for such inspections. The County will perform plans review in conjunction with the Ortutgc County Planning Department, until tlic Town Ict3pectur obtains the minimal ccrtificatian required for the Level of facilities to be reviewed. A minimtun of Level Two certification is required for Level One and Level Two Plans Review; and a Level Three certification is required for Level Three Plans Review. _ao~~
