4 <br /> RESOLUTION ACCEPTING THE OFFER OF A HIGH UNIT COST GRANT FROM <br /> THE STATE CLEAN WATER REVOLVING LOAN AND GRANT PROGRAM <br /> FOR <br /> THE CONSTRUCTION OF A PUMP STATION AND FORCE MAIN <br /> TO SERVE THE PINEY MOUNTAIN SUBDIVISION <br /> WHEREAS, it has been determined that the Piney Mountain <br /> Subdivision' s on-site wastewater treatment system has failed and that <br /> the sole remedy is the construction of a sewerage pumping station and <br /> force main which will connect the STEP and collection systems serving <br /> the subdivision to the collection system owned and operated by the City <br /> of Durham; and <br /> WHEREAS, Orange County, Orange Water and Sewer Authority and the <br /> Piney Mountain Homeowners Association have entered into a series of <br /> agreements governing the financing, construction, operation and use of <br /> the collection system, pump station and force main; and <br /> WHEREAS, Orange Water and Sewer Authority and the City of Durham <br /> have entered into an agreement permitting the City to receive <br /> wastewater from the Piney Mountain Subdivision; and <br /> WHEREAS, Orange County, on March 31, 1994, submitted an <br /> application for a High Unit Cost Grant from the State Clean Water <br /> Revolving Loan and Grant Program; and <br /> WHEREAS, the NC Environmental Management Commission, in September <br /> 1994, did allocate $88,500 in High Unit Cost Grant funds for the <br /> construction of a wastewater pumping station and force main to serve <br /> the Piney Mountain subdivision; and <br /> WHEREAS, Orange Water and Sewer Authority has advertised bidding, <br /> accepted bids, awarded a bid, given notice to proceed and supervised <br /> the execution of the contractual construction activities necessary to <br /> build a wastewater pumping station and force main; and <br /> WHEREAS, the property owners in the Piney Mountain subdivision, <br /> though the Piney Mountain Homeowners Association, have collected and <br /> deposited with Orange County some $348,850 to fund the construction of <br /> the wastewater pumping station and force main; and <br /> WHEREAS, Orange County has created a project account with the <br /> funds provided by the Piney Mountain Homeowners Association and has <br /> either expended, encumbered or been invoiced for approximately $290,000 <br /> from the Piney Mountain project account for engineering, administration <br /> or construction related expenses; and <br /> WHEREAS, Orange County and OWASA staff have identified additional <br /> construction, engineering and administrative expenditures, beyond those <br /> have already been expended, encumbered, etc. , which are necessary to <br /> achieve a fully functional wastewater treatment system and which are in <br /> excess of the funds currently on hand; and <br />
