Sole Source Justification Letter and Jovana Amaro, 919.245.2651 <br /> Documentation Alan Dorman, 919.245.2658 <br /> PURPOSE: To: <br /> 1) Approve the County entering into a service contract with Siemens Industry, Inc. for the <br /> replacement of the Animal Services and Whitted Complex Fire Alarm systems; and <br /> 2) Authorize the County Manager to execute the Agreement, subject to final review by the <br /> County Attorney, and any subsequent amendments for contingent and unforeseen <br /> requirements up to the approved budget amount on behalf of the Board. <br /> BACKGROUND: In FY2025-2026, the Orange County Board of County Commissioners (BOCC) <br /> approved within the Capital Investment Plan (CIP) funding to replace the Fire Alarm systems for <br /> the Animal Services Facility and the Richard E. Whitted Complex. <br /> The Fire Alarm systems at the Animal Services Facility and the Richard E. Whitted Complex are <br /> outdated and past their useful life, and replacement parts are no longer available. The Area of <br /> Rescue Assistance within Whitted Building "A" must also be updated, as it is attached to the fire <br /> alarm system, and is obsolete and cannot be repaired. <br /> The contract with Siemens Industry, Inc. involves a proprietary equipment design that integrates <br /> with the existing fire alarm and control system maintained by the County. Therefore the award is <br /> based on an exception to the bidding requirements. <br /> This exception to the competitive bidding requirements is found in North Carolina General Statute <br /> 143-129(e)(6), "Purchases of apparatus, supplies, materials, or equipment when: (i)performance or price competition for <br /> a product are not available; (ii) a needed product is available from only one source of supply, or (iii) standardization or <br /> compatibility is the overriding consideration. Notwithstanding any other provision of this section, the governing board of a <br /> political subdivision of the State shall approve the purchases listed in the preceding sentence prior to the award of the contract." <br />
