Compliance Letter from Town of Chapel Hill <br /> PURPOSE: To make a recommendation to the North Carolina Department of Transportation <br /> (NCDOT) and the North Carolina Board of Transportation (NC BOT) concerning a petition to add <br /> Zieger Lane and Cattail Lane in the Rusch Hollow Subdivision to the State Maintained Secondary <br /> Road System. <br /> BACKGROUND: This request includes a NCDOT petition for two (2) road additions to the State <br /> Maintained Secondary Road System. The road lengths and widths are as follows: <br /> Road Name Length in Number of Frontage Pavement and Right-of-Way <br /> Miles Lots with Houses Widths in Feet <br /> Zieger Lane 0.13 11 22-ft pavement, 50-ft Right-of-Way <br /> Cattail Lane 0.05 4 22-ft pavement, 50-ft Right-of Way <br /> Total 15 <br /> The Rusch Hollow Subdivision is located in Orange County along Rogers Road (State Road (SR) <br /> 1729) (Attachments 1 and 2). This single-family residential subdivision is within the Town of <br /> Chapel Hill's Extra-Territorial Jurisdiction (ETJ). However, per North Carolina General Statutes <br /> §136-62, the Board of County Commissioners (BOCC) is an appropriate governing body to <br /> approve the road addition request associated with the subdivision. There are no known violations <br /> associated with the subdivision, as confirmed by the Town of Chapel Hill (Attachment 5). <br /> The Rusch Hollow Subdivision was recorded on November 18, 2004 (Plat Book 96 Page 84) <br /> (Attachment 3). Zieger Lane and Cattail Lane were originally platted and designed to meet public <br /> road standards, but have been maintained private roads in the interim. The roadways were <br /> intended to become public roads when conditions met NCDOT maintenance responsibility and <br /> ownership criteria, as reflected on the recorded plat. <br />
