Gordon Battle Courtroom in Hillsborough, North Carolina. <br /> COUNTY COMMISSIONERS PRESENT: Chair Barry Jacobs and Commissioners Moses <br /> Carey, Jr., Valerie P. Foushee, and Alice M. Gordon <br /> COUNTY COMMISSIONERS ABSENT: Mike Nelson <br /> COUNTY ATTORNEYS PRESENT: Geoffrey Gledhill <br /> COUNTY STAFF PRESENT: County Manager Laura Blackmon, Assistant County <br /> Managers Willie Best and Gwen Harvey, and Clerk to the Board Donna S. Baker (All other <br /> staff members will be identified appropriately below) <br /> Chair Jacobs said that there was a special meeting notice for a meeting before the <br /> regularly scheduled meeting. He asked for a motion: <br /> To go into closed session pursuant to G. S. 143-318.11(a)(3) to consult with an attorney <br /> retained by the Board in order to preserve the attorney-client privilege between the attorney <br /> and the Board, concerning the cases of: (1) Galleria of North Carolina, LLC v. County of <br /> Orange, Orange County Superior Court File No. 08 CVS 000192 and (2) Orange County v. <br /> Huerta, Orange County Superior Court File NO. 08 CVS 343. <br /> And to go into closed session pursuant to G. S. 143-318.11(a)(5) to discuss the County's <br /> position and to instruct the County Manager and County Attorney on the negotiating position <br /> regarding the terms of a contract or contracts to purchase real property, PIN 9854-70-2643, <br /> owned by the Effie Draper-Savage-Nellie Draper Dick Memorial Foundation, to be used for <br /> conservation purposes. <br /> A motion was made by Commissioner Gordon, seconded by Commissioner Carey to go <br /> into closed session for the above purposes. <br /> VOTE: UNANIMOUS <br /> NOTE: ALL DOCUMENTS REFERRED TO IN THESE MINUTES ARE IN THE PERMANENT <br /> AGENDA FILE IN THE CLERK'S OFFICE. <br /> 1. Additions or Changes to the Agenda <br /> Chair Jacobs went through the items at the County Commissioners' places. There <br /> were several documents provided by citizens. <br /> The lavender sheet was a revised Planning Board appointment sheet. There was a <br /> draft agenda for the October 14th work session. Chair Jacobs encouraged the County <br /> Commissioners to make any comments to the Manager or the Clerk because there was a little <br /> bit of a change to what was originally planned. <br />
