I would want you to ask the staff 4 to name those neighboring roads. 5 Chair Jacobs: We'll get to the specifics of the recommendation. 6 Commissioner Gordon: In terms of the action to #3 in the Manager's 7 recommendation, the first part, "Take action to approve the application, and impose 15 8 recommended conditions.....and the Resolution of Approval." But it isn't laid out exactly that 9 way in any one document. I would have accepted a Resolution of Approval that you have listed 10 with the conditions somehow in. I would need to understand that if it is a Resolution of Approval 11 that you are moving the Resolution near the end, plus the recommended conditions. 12 Chair Jacobs: Commissioner Gordon is essentially questioning the way in which it was 13 presented, I had the same reaction. 14 Commissioner Gordon: I would have thought that there would have been a resolution 15 that listed all of the conditions. 16 Geof Gledhill: I would recommend two things about the Resolution of Approval when 17 you get to it. One of them is that you incorporate the conditions into the Resolution of Approval, 18 and the second is that the Now, Therefore Be it Resolved language in the first resolution be 19 changed from "is denied" to "is approved." 20 21 A motion was made by Commissioner Carey, seconded by Commissioner 22 Foushee to close the public hearing according to the worksheet provided in Attachment 23 2. 24 VOTE: UNANIMOUS 25 26 Geof Gledhill: I think the Now, Therefore Be it Resolved would be, and I'm looking at 27 the Resolution of Approval, the resolution should say, "The special use permit is approved 28 subject to the recommended conditions of approval. The Attorney suggests specificity regarding neighboring roads, which I assume are Terry 32 Road, New Sharon Church Road, and St. Mary's Road. 33 Geof Gledhill: My preference would be not to include any future roads yet to be built or 34 named. 35 Commissioner Gordon: I guess the other thing is, I don't know exactly how the 15 36 conditions relate to the findings. 37 Geof Gledhill: How many of the conditions are necessary in order to make positive 38 findings, I think the staff can answer that. 39 Chair Jacobs: It would seem that we probably should approve or address the findings 40 of fact because the conditions relate to the findings of fact. If someone wants to address a 41 specific finding of fact, we could do that, or if you want to address the findings of fact in total, 42 we could do that. There was a question about which of the conditions address necessary 43 findings. 44 45 Michael Harvey went through each condition on page 35: 46 1. There is a condition addressing a requirement for all special use permits that will be 47 mitigated as best they can. Specifically, under #1, we're requiring a 30-foot buffer to try to 48 eliminate the off-site impacts, the visual obstructions, we've recommended that condition be 49 adopted in terms of adhering to one of the findings as part of the special use permit.
