Michael Harvey said that a lot of things would have to happen before the SUP would be <br /> revoked. There are conditions designed to ensure that the specificity of the application is <br /> carried out. There are also conditions that have been imposed to address concern for the <br /> potential for this project to be annexed. There are conditions that are designed to ensure that, <br /> for any development within the districts, off-site transportation improvements will have to be <br /> completed in order to guarantee that the work is done. It is ultimately up to the Board to <br /> determine, with the applicant's participation, what will be imposed. <br /> Craig Benedict explained the chart regarding the conditions. <br /> Commissioner Foushee made reference to condition 27 that relates to the Board of <br /> County Commissioners engaging the process to develop a more formal interlocal agreement <br /> with the City of Mebane. This is a situation where the Board of County Commissioners has to <br /> initiate and the developer cannot meet this condition. There are other examples similar to this. <br /> Craig Benedict said that there will be some administration comments on these <br /> conditions. <br /> Chair Jacobs asked the developer if there were any comments. <br /> Jim Parker said that they were in attendance to answer any questions. <br /> Chair Jacobs asked if there would be any fences and Michael Harvey said that there <br /> are none proposed but there will be retaining walls. <br /> Chair Jacobs said that the common design for shopping centers is to fence off the rear <br /> of a center to residential, and the people that live right next to it have to get in their cars and <br /> drive all the way around to get to what is right next to them. If this is not addressed, then it is <br /> not happening, presumably. <br /> Chair Jacobs asked if there were any more access roads onto N.C. 10 and Michael <br /> Harvey said that there is only one access now, which will be signalized. Michael Harvey <br /> reminded the Board that as each site plan is submitted, revised transportation improvement <br /> documents have to be submitted for review and approval by NCDOT. Additional external and <br /> internal traffic improvements may be required by NCDOT above and beyond what has been <br /> proposed in the conditions. Chair Jacobs said that he is more concerned about the impact on <br /> rural character on the neighborhood across, south of West Ten Road. Michael Harvey said <br /> that the deletion of the truck access will alleviate some of the traffic congestion. <br /> Chair Jacobs asked about the possibility of some of the residential units being <br /> affordable. Michael Harvey said that this is a condition that is still being reviewed. Chair <br /> Jacobs wants to make sure that this is not forgotten. <br /> Chair Jacobs said that if there is going to be a 200-unit multi-family structure then there <br /> should be a room for exercise and Michael Harvey said that is still being reviewed. <br /> Chair Jacobs said that another issue raised at the public hearing was a contribution to <br /> public transportation, and that the County is working on an east-west route for public <br /> transportation. Michael Harvey said that this has been discussed, and it will be more beneficial <br /> for the applicant to answer this. <br /> Chair Jacobs asked about the one acre that is being offered at the southeastern <br /> corner, and if this is being given to the County. Michael Harvey said that staff has not come up <br /> with a final recommendation yet. Chair Jacobs referred staff to Waterstone, which gave three <br /> acres, and the development is three times the size as Buckhorn Village. <br /> Chair Jacobs made reference to buffers and asked to see some illustrations when this <br /> comes back. Craig Benedict distributed some sketches of the buffer. <br /> Chair Jacobs thanked the staff for all of the work that has been done. <br /> Jim Parker made reference to the government area designated on the plan and said <br /> that this land was to be given to the County for any intended use.
