28. "Can we ship out of State? " <br />Although it is possible to transfer C &D waste to distant facilities, this is generally not a <br />satisfactory and cost - effective solution to managing this waste stream, due to its weight <br />and bulkiness. We understand that this issue has been previously considered by the LOG. <br />29. "Is it not true that even good or "best" designs for waste facilities have failed? <br />(example: hog lagoons or other dump sites across the country.) " <br />Engineered designs are the product of trained, licensed professionals who incorporate <br />site - specific data, empirical knowledge and educated assumptions into the final product. <br />As with any human endeavor, it is true that some designs do not perform their intended <br />function as well as expected. There are a multitude of reasons for this, and failure <br />analysis is an important area of study for engineering professionals. Regarding hog <br />lagoon failures in particular, the lack of careful design and regulation is at least part of <br />the problem. Such lagoons have not been subject to close regulation in North Carolina, <br />and those facilities that have failed are certainly not examples of "best" designs. Failures <br />at older waste facilities of all types, including landfills, are the very reason that the <br />current set of comprehensive environmental regulations is in place. <br />30. "Is the Landfill Owners Group still in existence? <br />The Landfill Owners Group has not formally been dissolved, however, as you state, for <br />all intents and purposes, it no longer exists. Solid waste management in Orange County <br />is currently in flux. The assumption of countywide solid waste management <br />responsibilities by Orange County from Chapel Hill is imminent. It is awaiting only the <br />final signatures on the legal agreement. Once this document is finalized, Chapel Hill and <br />Carrboro will relinquish all solid waste management responsibilities to Orange County, <br />maintaining essentially only an advisory involvement thereafter. The current Chapel Hill <br />Solid Waste Management Department will be transferred to Orange County. <br />As a part of this transfer of responsibilities, a Solid Waste Advisory Board will be created <br />which will consist of representatives of Carrboro, Chapel Hill, Hillsborough, and Orange <br />County. It will function as an advisory board to the Board of Orange County <br />Commissioners on matters involving solid waste management. <br />31. "Has the Board responded to the request by the Durham County Commisioners to <br />conduct an independent assessment of the Guess Road site? " <br />The only request formally received by the Orange County Board of County Commissioners <br />is a Sept 25 letter requesting that Orange County allow Durham County representatives to <br />make an inspection of the proposed site to determine if endangered and threatened species <br />are found on the site.
