23. Please comment on endangered species, owls in particular, and explain why no <br />natural heritage inventory was taken for the Guess Road site. <br />The siting process is being carried out with reference to the inventories maintained by the <br />North Carolina Natural Heritage Program (NCDENR — Division of Parks and Recreation), <br />and Orange County. Orange County's inventory had no information regarding <br />endangered species in this area. The state issued a letter dated June 3, 1999 in response to <br />our request regarding the potential. presence of threatened or endangered species and their <br />habitats in the proposed site. They stated that there was no information regarding <br />threatened or endangered species or their habitat on the site. This would include owls. <br />However, because there are records of rare species, high quality natural communities, and <br />a Significant Natural Heritage Area (the Little River Aquatic Habitat) within a 1.0 mile <br />radius of the site, they request that U.S. Army Corps of Engineers Best Management <br />Practices be followed to prevent siltation in the North Fork/Little River aquatic habitat: <br />The loss of silt from the site into the streams in this area is considered to be the greatest <br />threat to these creatures, since the listed rare species are all aquatic (fish or freshwater <br />mussels). Therefore, sediment and erosion control measures on the site will be designed, <br />constructed and maintained in accordance with the most stringent standard or better. <br />24. "Please clarify the 25, 50 & 100- year flood zones. " <br />The terms refer to the probability that a flood of a certain size will occur in a given year. <br />For example, the 25 -year flood has a 1 -in -25 probability of occurring in a given year. <br />25. "What is Orange County going to do about property devaluation? " <br />We have no reason to believe that property values will decrease, based on Eubanks Road <br />and other facilities in the state as a model. <br />26. "What is going to be done about air quality (dust) and noise? " <br />The facility will be designed with minimum 200 -foot buffers between any property <br />boundary and the actual landfill footprint. The working face of the fill area (from which <br />most dust and noise would originate) is likely to be much further from the property <br />boundary at any given time during the life of the facility. This distance will serve to <br />attenuate noise and dust effects from earth moving activities. Additionally, water trucks <br />will be used on cleared areas as needed to suppress dust during dry periods. <br />27. "Will the State of N. C. do an engineering report? " <br />Engineers and geologists at the NC Solid Waste Section review the Site Applications and <br />the Design Applications for C&D landfills, and issue a response requiring any necessary <br />changes to the plans. They may also choose to deny a permit for the site if it does not <br />meet regulatory requirements. <br />Responses to Questions 8 Joyce Engineering, Inc. <br />
