21 <br />AMENDMENT 2: AMEND A) SECTION III-D-3 PRELIMINARY PLAT APPROVAL; B) SECTION 1V- <br />B-10 FLEXIBLE DEVELOPMENT, SECTION B APPLICABILITY; AND C) SECTION IV-B-10, SECTION <br />D.1 (DEVELOPMENT STANDARDS) ESTATE LOT OPTION TO MODIFY MAJOR SUBDMSION <br />APPROVAL PROCEDURES FOR THE ESTATE OPTION OF FLEXIBLE DEVELOPMENT BY PROVIDING <br />FOR APPROVAL OF THE PRELIMINARY PLAT BY THE ORANGE COUNTY PLANNING BOARD (NO <br />APPROVAL BY THE BOARD OF COUNTY COMMISSIONERS.. THIS WOOD SHORTEN THE TIME <br />REQUIRED TO OBTAIN APPROVAL OF THE MAJOR SUBDIVISION. <br />(A) <br />SECTION III-D-3 PRELIMINARY PLAT APPROVAL <br />*111-D-3-c. Planning Board Review Procedures <br />*Amended <br />1/8/90 The Planning Board shall review the application and the Planning <br />Department's report and shall prepare a written recommendation to <br />the Board of Commissioners. All interested persons shall be given <br />the opportunity to speak and-ask questions regarding the application. <br />The Planning Board may place reasonable and fair limitations on <br />comments, arguments and questions to avoid undue delay. <br />The Planning Board shall take action on the application solely on its <br />findings as to compliance with applicable regulations and conditions <br />and shall: <br />(1) Recommend approval of the application; <br />(2) Recommend approval subject to conditions; or <br />(3) Recommend denial. of the application. <br />Preliminary slat applications using the estate lot option of <br />flexible develoQment shall be approved by the Planning Board <br />and do not require approval by the Board of County <br />Commissioners. The Planning Board shall take action on an <br />apalication usina the estate lot option of flexible develoament <br />preference Section IV-B-10, Section D.1) solely on its findings as <br />to com,.pliance with applicable regulations and conditions and <br />shall: - <br />L.1 Recommend approval of the aaalication: <br />jZj Recommend approval subject to conditions; or <br />u Recommend denial of the application. <br />g:lbctamendlftexdev\pbrec.docl8-17-99Uc1 <br />
