Memorandum to the Board of County Commissioners and Planning Board of <br />August 4, 1999. <br />• Because the property is located within the I-40/85 MTC Major Transportation <br />Corridor District, stipulations of Section 6.26 Extra Requirements for the Maior <br />Transportation Corridor (MTC) District of the Zoning Ordinance apply. Please <br />refer to the attached General Information Memorandum. <br />17 <br />Proposed: The Cates wish to rezone 2.8 acres of their 5.1$a tract from AR to AS in order to <br />begin a business which would be compatible with the Comprehensive Plan and AS <br />provisions of the Zoning Ordinance. <br />• The proposed zoning is AS(LTPPER ENO-CA}-Agricultural Service (Upper Eno- <br />Critical Area). <br />• Minimum lot size is two acres. <br />• Permitted use includes rural non-farm, non-residential development which supports <br />the horticultural, silvicultural, and agricultural uses of AR districts. <br />Development Processes. Schedule. and Action <br />• Public Hearing August 23,1999: The public was heard. No decision was made <br />on the proposed amendments by either the Planning Board or the Board of County <br />Commissioners at the public hearing. The proposal was sent to the Planning Board <br />for recommendation to be returned to the Board of County Commissioners no <br />earlier than September 21, 1999. Please refer to the draft minutes of the public <br />hearing attached to this abstract. <br />• First Action: Planning Board Recommendation: The Planning Board has 75 <br />days within which to prepare and submit a recommendation to the Board of County <br />Commissioners. Failure of the Planning Board to submit a recommendation within <br />the required time shall be considered as a favorable recommendation. <br />• Final Action: The Board of County Commissioners will consider amendments <br />to the Orange County Zoning Atlas no sooner than September 21,1999. <br />RECOMMENDATIONS: <br />Zoning Officer Recommendation <br />The Zoning Officer recommends approval of the rezoning. <br />• The request complies with the provisions of the Comprehensive Plan. <br />• The proposal meets all dimensional requirements. <br />• Permitted uses listed for the proposed AS district are appropriate to service the <br />surrounding agricultural uses. Please refer to the attached General Information <br />Memorandum. <br />Hinkley stated that the recommendation from the staff is that the property should be rezoned <br />based on the three above-mentioned facts. <br />17 <br />
