2 <br />Proposed Conditions: <br />Open Space: • 36% open space remaining in private ownership on individual lots; <br />• Protects Rocky Run, the 100 Yr. flood plain and adjacent stream buffer, <br />Natural drainage swale across lots 1 through 7 and <br />Buffer along Dimmocks Mill Road and the eastern subdivision boundary. <br />Open Space: • 40-foot wooded buffer across the northern boundaries of Lots 7, 8 and 9 <br />• 40-foot buffer along Moorefields Road <br />Access: • Off north side of Moorefields Road by <br />• Two new public roads: Pine Ridge Road and Cedar Ridge Road <br />• Publicly dedicated stubout with a 40' X 50' (temporary) turn around at the end of <br />Pine Ridge Road at northern property boundary. <br />Water and Sewer: • Individual wells for all 25 lots; <br />• Conventional septic systems for 18 lots; <br />• Innovative septic systems for 7 lots; <br />• Septic easements in common open space for Lots 1 and 2. <br />Miscellaneous: • 30-foot drainage easement along draw across Lots 12 and 11. <br />• Developed in four phases: Phase I, 5 lots (Lots 1 - 3, 24,25); <br />Phase 2, 9 lots (Lots 13 - 21); Phase 3, 6 lots (Lots 4 - 8, 23); <br />Phase 4, 5 lots (Lots 9 - 12, 22). <br />Agency Comments <br />Requests for agency review were sent to: NCDOT, Erosion Control, Recreation and Parks, Orange <br />County Schools, County Attorney and Fire Marshall. Preliminary plat addresses all comments <br />received. <br />Development Process, Schedule, and Action <br />Planning Board: <br />• First Action: Concept Plan approved December 3, 1997, (7 to 4 vote) with conditions: <br />please refer to attached 12/3/97 Planning Board minutes <br />• Second Action: Preliminary Plan approved (unanimous vote) February 3, 1999 with <br />provisions stated in the Resolution of Approval: please refer to the attached 2/3/99 Planning <br />Board minutes. <br />Board of County Commissioners: <br />• Third Action: Preliminary Plan denied March'16, 1999, (unanimous vote) <br />• Fourth Action: Motion to Reconsider passed August 17, 1999, (unanimous vote) <br />• Final Action: Board to Consider Revised Preliminary Plan. <br />Options: <br />(1) Approve the application; <br />(2) Approve the application subject to conditions; or <br />(3) Deny the application. <br />If approved the applicant shall have one (1) year to prepare and file a Final Plat or to request a <br />one-year extension from the Planning Director. <br />FINANCIAL IMPACT: Fiscal Impact Analysis included as an attachment. <br />g:1 klincoln\wdgmabs.docl9-21-99Uc1 <br />
