BOOK ]r4LE 2S4 <br />Mr. Ward brought to the attention of the Board a problem which the Board of Social <br />Services had encountered. Mr. Ward stated that Triangle Nursing .Homes, Inc, had requested <br />that the Orange County Board of Social Services be responsible for ambulance costs involving <br />Orange County residents who were staying in Triangle Nursing Homes # 1 and 2. Mr. Ward <br />stated that in the deliberations of the past few months, the Orange County Hoard of Social <br />Services had agreed to pay the bill of 51,804.00 which had been submitted by Triangle <br />Nursing Homes, Inc.; however, the Board of Social Services felt that they should not be <br />responsible for the transportion of Orange County residents after ,Lune 1, 1470 and that . <br />the Director of the Nursing Homes would be advised of the policy adopted by his Hoard. <br />Mr. Ward reported to the Commissioners that the Social Services Board had decided to pay <br />a portion of the bill and that the Nursing Home be advised in the futura= to contact <br />the Durham Ambulance Service for the transportation of Orange County citizens to their -~ <br />desired destination. <br />The County administrator submitted the following items. He advised the Hoard <br />~- that John Cate was requesting a refund of 586.16 as there had been an error in the <br />acreage accessed for county taxes and that the tax bill had been payed. <br />Upon motion of Commissioner Bennett, seconded by Commissioner Ray, it was moved <br />and unanimously adopted that the County Administrator issue a refund to John Cate in Sae <br />amount of $d6.16. <br />The County Administrator advised the Hoard that the Attorney General had requested <br />that a new contract of agreement be signed by Orange County with the North Carolina <br />Local Governmental Employees' Retirement System. Upon motion of Commissioner Bennett, <br />seconded by Commissoner Ray, it was moved and unanimously adopted that the following <br />contract be executed. <br />AGREEMENT-DEATH BENEFIT <br />General Employees <br />In accordance with the provisions of subsection (1) of G.S. <br />128-27 setting forth the conditions under which the rights to the <br />death benefit might be made available to members of the North <br />Carolina Local Governmental Employees' Retirement System, this <br />AGREEMENT is hereby entered into between the County Commissioners <br />of Orange County and-the Director of said Retirement System. <br />In consideration of an increase of .37% in the employer's - <br />contribution rate effective as of Suly 1, 1970, the North Carolina <br />Local Governmental Employees' Retirement System hereby agrees to <br />extend the privileges and rights of the death benefit described in <br />subsection (1) of G.S. 128-27 to the employees of the Orange County .' _ <br />who are members of said System on and after the above effective <br />date. This Agreement shall continue in effect from year to year <br />with the understanding that the rate payable for this death benefit <br />may be modified as the System's Actuary may periodically determine. <br />Approval of the above increase in rate was authorized by <br />Orange County Hoard of Commissioners at its meeting on June 1, <br />1970 and is recorded in the minutes of said Board. <br />A letter from Nathaniel Frothingham, 124 Polk Street, Chapel Hill, North Carolina, <br />was presented. Mr. Frothingham requested the release of 54.63 penalty which had <br />been imposed because of late listing of personal property tax. <br />Upon motion of Commissioner Sennett, seconded by Commissioner Ward, it was moved <br />and adopted that the request of Mr. Frothingham be denied. <br />A letter from William L. Fleming was presented. Mr. Fleming requested that the <br />Kawanis Club be authorized to hold its annual fourth of July fireworks display in <br />Kenan Stadium at 8 o'clock P.M. <br />Upon motion of Commissioner Ward, seconded lay Commissioner Bennett, it was moved <br />and adopted that the Kiwanis Club be authorized to proceed with their fireworks display <br />provided that said display was held under the supervision of the Chapel Hill Fire <br />Department. <br />A letter from Richard G. Coleman requesting the release of S1D.46 pena]ty which had <br />been imposed because of late listing of tax. <br />Upon motion of Commissioner Wald, seconded by Commissioner Sennett, it was moved <br />and adopted that the request of Mr. Coleman be denied. <br />The County Administrator inquired as to the dispostion of the request relative to <br />the naming of Highway #751. Chairman Smith stated that action taken at a previous <br />meeting endorsed the naming of the highway and that Ed Swindell, Durham County Manager, <br />should be advised of said action. <br />The County Administrator informed the Board that the Orange County Rescue Squad had <br />made application for a Federal grant and that someone should be authorized to sign the <br />contract relative to said grant. <br />
