Draft 10/8/99 <br />In this fashion, a program such as outlined herein, after agreement <br />by the Board of Commissioners, could be instituted as desired. This <br />.would include the ability to hold land under fee-simple and <br />conservation easement arrangement,- as well as the other possible <br />tools mentioned in Section V. <br />The. benefits of this- approach are its simplicity and potential <br />immediate use. under existing statutory .authority. No legislative <br />approval would be needed in this case. A Lands Legacy. program <br />under these. auspices could- be adopted and in place as .quickly as <br />desired.. This approach could also-serve as a short-term structure <br />while other,. more-complicated means are explored. <br />One .potential area of concern with this structure might be adoption <br />of this .method without_a concurrent agreement on the use of the <br />:land acquired. Potential sellers may be interested ~ in .knowing the <br />County's .long-term disposition and planned use for the land. This <br />- may be addressed however, by a statement of use and intent when <br />the .property is purchased. Establishing a County Land Trust <br />As mentioned in the 1996 Preservation as a Function of Local <br />.Government report, the establishment of a County land trust is one <br />approach that has been taken by other jurisdictions around the <br />nation. <br />In this option (as used in places-like Davis, California, Anne Arundel <br />County, Maryland, and Boulder, Colorado), the County would file <br />papers to create a 501(c)3 non-profit corporation which could be <br />funded by appropriation from the County, or by a combination of <br />39 <br />
