affected Property owners and to all adjacent property <br />owners within 500 feet as provided above. <br />The Zoning Officer shall certify the mailing of all such <br />notices to the Board of County Commissioners. <br />20.7 Action 194912429—t to the Vate 21 Public AsArjqq <br />20.7.1. Following the date of public hearing, all proposed <br />amendments shall be referred to the Planning Board for its <br />Amended c•onsideration and-recommendation. Evidence not presented <br />2/5/90 at the joint public hearing (hereinafter called "new <br />evidence") may be submitted in writing at or prior to the <br />PI , anning Board meeting at which the recommendation to the <br />Board of Commissioners is made., The Planning Board may <br />consider oral evidence only if it is for the purpose of <br />presenting information also submitted in writing. <br />The Planning Board shall within sixty days after the date <br />of the public hearing prepare and submit for the Board of <br />County Commissioners a recommendation concerning the <br />disposition of any application submitted by the public. <br />Said time limit may be extended upon request of the <br />applicant. Amendments initiated by Orange County shall not <br />be subject to time limitations other than those specified <br />by the Board of County Commissioners during the public <br />hearing process. <br />Failure of the Planning Board to submit a recommendation <br />within the required time shall be considered a favorable <br />recommendation, without conditions. <br />20.7.2 The Board of County Commissioners shall not consider <br />enactment of the proposed amendment until sixty days after <br />Amended the first date of the public hearing or until the Planning <br />2/5/90 Board makes this recommendation, whichever comes first. In <br />making its decision, the Board of Commissioners shall <br />consider all relevant evidence presented at the joint <br />public hearing, and any new evidence which was considered <br />by the Planning Board in making its recommendation. <br />New evidence which was not presented in writing to the <br />Planning Board may not be considered by the Board of <br />Commissioners in making a decision unless the joint public <br />hearing is reopened to receive said evidence, and the item <br />is re-advertised and/or referred back to the Planning Board <br />for recommendation. <br />20.8 Withdrawal 2.f A22ligation <br />An applicant may withdraw his or her application at any <br />time by written notice to the County Manager. However, any <br />withdrawal of an application after the giving of the first <br />notice as required in 20.6 shall be considered, for the <br />purposes of Article 20, a denial of the petition. <br />_D <br />
