Ordinance amendments are legislative zoning decisions. <br />BACKGROUND: <br />Request <br />Amendments, resulting from a three-year study of Cane Creek Watershed conducted by the Orange Water <br />and Sewer Authority (OWASA), propose changes to Article 22 (Definitions) and Article V11, Section 6.23 <br />(Extra Requirements for Watershed Protection Overlay Districts) of the Orange County, Zoning <br />Ordinance and to Section IV-13-10, Flexible Development, of the Orange County Subdivision <br />Regulations to implement new watershed protection measures for Cane Creek watershed. These <br />changes incorporate subsequent recommendations made in October, 1997, by the OWASA Board of <br />Directors. <br />Location <br />The proposed amendments will affect future development within the Cane Creek watershed. <br />Existing and Proposed Conditions <br />Existing: ® Maximum density: 1 du/2 acres. <br />• 33% open space requirement in flexible development subdivisions using the <br />conservation, or cluster option (conservation-cluster). <br />Proposed: • Maximum density: I du/ five acres; Lots of record existing on date of adoption may <br />contain up to, but no more than, five lots as small as two acres in size. <br />Flexible development subdivisions; allowed with overall density of 1 du/2 acres <br />provided 60% of total area is reserved as open space. <br />0 50% open space requirement in flexible development subdivisions within the <br />Cane Creek watershed. <br />g:\ txtamend \canecrk\boccabs.doc \10- 6 -99 \kl <br />
