Davis, Planning Supervisor <br />245.2580 <br />PURPOSE: To hear and take action on an appeal of a subdivision application for the <br />Yeargan Estate minor subdivision that was approved by the Planning Department subject <br />to compliance with a provision contained within the County Subdivision Regulations that is <br />objectionable to the applicant. <br />BACKGROUND: <br />Property Location: 3800 Block of Whitfield Road in the Chapel Hill Township. The tract, <br />on its northern boundary, abuts Duke Forest. (see attached map) <br />Acreage: 19.62 ± Acres <br />Proposed Lots: 2 <br />Zoning: Rural Buffer (Jordan Lake Unprotected Watershed) <br />School System: Chapel Hill-Carrboro City Schools <br />PIN: 9881-90-8749 <br />Applicant Diane Chappell has appealed the Planning Department's approval of the <br />Yeargan minor subdivision to the Board of County Commissioners (hereafter the "Board"). <br />The Applicant objects to a condition of the Planning Department that limits direct driveway <br />access to an arterial street. The Applicant is requesting that the Board allow two separate <br />access points into the proposed subdivision from Whitfield Road instead of the single <br />access required by-the Planning Department. This appeal is made following a February 7, <br />2008 Planning Department decision to reaffirm the minor subdivision approval with the <br />restricted access condition as required by the County's Subdivision Regulations. <br />The Subdivision Regulations provide an appeal process regarding subdivision decisions of <br />the Planning Department.
