ATTACHMENT3(c)- CONDITIONS OF APPROVAL (COA) <br />3 <br />The following is a detailed list of the various conditions recommended by the <br />ADMINISTRATION concerning the approval of this project. <br />These special terms and conditions shall encumber the development and bind the <br />owners and lessees, as well as their successors. These special terms and conditions <br />are required to be mutually agreed to by the Developer in order to be imposed. <br />It needs to be remembered, however, that the developer is required to develop this <br />project, including any and all internal and external improvements, in accordance with: <br />1. The provisions of the Orange County Zoning and Subdivision Regulations, <br />including the Economic Development District Design Manual and <br />2. Any and all applicable Federal, State, and local regulations. <br />These special terms and conditions are the only regulatory guidelines that are subject <br />to review and approval by the applicant. <br />If this project is approved all concept plans, reports, renderings, comments, <br />commitments, and supporting documentation contained within the record of the <br />Project's approval shall be incorporated and made a part of the Class A Special Use <br />Permit (hereafter `SUP'). <br />The Special Use Permit will contain a detailed description of all recommended <br />conditions along with renderings and examples of various standards for review and <br />comment. <br />With that, the following special terms and conditions are recommended for the approval <br />of the Buckhorn .Village Planned Development project: <br />A -OWNERSHIP AND MANAGEMENT: <br />1. BRA and/or their successors, by restrictive covenant or otherwise, shall <br />incorporate the various conditions and development standards, as detailed <br />herein, into all leases and/or individual sale documents ensuring the perpetual <br />adherence to all terms and conditions of this SUP and guaranteeing unified <br />control of the Project. <br />2. There shall be no subdivision of any portion of the Property, including all property <br />within any of the three (3) development districts, until the installation of all <br />required infrastructure has been completed. Provided, however, any subdivision <br />permitted by this SUP shall be subject to the requirement that the entire Properly <br />be subject to unified control. For purposes of this Section A.2., "infrastructure" <br />shall mean as follows: <br />a. All external roadway improvements required to support the Project as a <br />whole in accordance with NC DOT, Orange County, and City of Mebane <br />standards, <br />
