~X~I~~~~ <br />ZONING ARTICLE 14 <br />SITE PLAN APPROVAL PROCEDURES <br />1. The site plan process, including time line, is noted on the attached sheet. <br />2. When a use is permitted by right (in contrast to uses permitted by Special Use Permit <br />Class A or B or use requests requiring a rezoning), the site plan review process does <br />not include any requirement for public notice, hearing, or discussion of the proposed <br />project unless an Environmental Impact Statement (EIS) is required as outlined in the <br />County's Environmental Impact Ordinance. <br />3. In addition, the Planning Department and various internal and external review <br />agencies cannot ask or require additional conditions above and beyond what is <br />required by the Zoning Ordinance unless agreed to or volunteered by the applicant. <br />4. To address aspects of items 2 and 3 above the applicant can prior to submittal, <br />independently pursue the following. <br />The applicant is free to meet, on their own accord, with local property owner to <br />discuss the impacts of the project and identify solutions to address neighbor or <br />public concerns. If the applicant wishes to provide/proposes above code <br />enhancements, they may submit to the Planning Department these proposals for <br />review and action during the normal permit review process. <br />Note: When the County is the applicant of a site plan request such as a park or <br />solid waste transfer station, the process before submittal to a local .government <br />(the County Planning Department in this case) can capture the public involvement <br />input. The Board of County Commissioners reviews a guiding version of the site <br />plan and approves the submittal of a concept or master plan to the local <br />government. This plan can include whatever site plan attributes that have been <br />developed through the County's site development input processes before the site <br />plan submittal. <br />Source: Orange County Planning and Inspections Department October 2008 <br />
