7 <br />T,.`INLTES OF THE ORANGE COUNTY BOOK PACE 229 <br />BOARD OF CG"ILIISSIONERS <br />September 15, 1969 <br />The Board of County Commissioners of Orange County met in special session <br />at 8 o'clock P.Y. on Monday, September 15, 1969, in the Courtroom of the <br />Courthouse in Hillsborough, North Carolina, for the purpose of conducting a <br />k'ublio Hearing, as duly advertised in the Clews of Orange, on the question of <br />adoption of two ordinances entitled: "An Ordinance Authorizing the Chairman or <br />the Board of Commissioners To Proclaim Restrictions in Response To Needs of an <br />Emergency" and "An Ordinance To Permit Dispersal of Assemblies Iluririg an <br />Emergency". <br />Members Present: Vice Chairman Henry S. Walker and Commissioners Harvey D. <br />Bennett, William C. Ray and Ira A. Surd. <br />Members Absent: Chairman Carl''. Smith. <br />Lucius M. Cheshire, County Attorney, read both Ordinances and explained <br />them to the group present. <br />Clarence Jones, Chairman of the County Human Relations Council, and several <br />Council Members, were present. Their interest seemed more closely related to <br />the fair and uniform application of the Ordinances than in the adoption or non <br />adoption of the Ordinances. <br />All persons present were given an opportunity to speak either in support <br />of or in opposition to the proposed Ordinances. :'here being no further discussion <br />Vice Chairman '.7alker declared the Public Hearing adjourned. <br />The County attorney, Lucius 1'. Cheshire, reported to the Board that the <br />condemnation suit against Iurs. Bertha Evans was now docketed in the Superior Court. <br />The Commissioners who had been appointed,-by the court, had awarded -'3,300.00 <br />to Mrs. Evans as settlement for the right of way grievances, however, sirs. Evans <br />was not satisfied with the amount awarded and offered to settle her claim for <br />?4,700.00. The County Administrator and the County Attorney had declined to <br />accept settlement of the matter. The County Attorney stated that Airs. Evans was <br />now offering to settle the suit and was requesting ti-at she be paid x`3,500.00 <br />which is ?200.00 more than the court appointed Commissioners agreed upon. The <br />County Attorney and the Count Administrator recomuended that this eward figure <br />be revised from ?ti3,300.00 to -33,500.00. <br />Upon motion of Commissioner Ward, seconded by Commissioner Bennett, it was <br />moved and unanimously, adopted, that the County ?Lttorney proceed to settle the <br />suit against Airs. Evans and that Pars. Evans be awarded the sum of :$3,500.00. <br />Dr. 0. David Garvin was present to discuss with the Board the supplemental <br />food distribution program. Dr. Garvin stated that currently federal regulations <br />prohibited more than one type of distribution program per county, however, he <br />stated that there was sentiment towards the elimination of this restriction and <br />that he and Paul Alston would continue to explore the possibility of instituting <br />more than one type of food program in the county. <br />There being no further business to come before the Board said meeting was <br />adjourned. <br />Henry.
