Chief Information Officer Todd Jones said that he does not recall the figure, but it must not exceed $12,000. He recommended deleting #4 and approving the contract, not to exceed $12,000. A motion was made by Commissioner Gordon, seconded by Commissioner Carey to approve the contract with Kelly Marcom, with the deletion of#4, for an amount not to exceed $12,000, and authorize the County Manager to execute the contract pending final review by staff and the County Attorney. VOTE: UNANIMOUS Justice Facility Site Lighting Utilities Right-of-Way Agreement with Duke Energy The Board considered approving a Right-of-Way Agreement for the installation and . maintenance of electrical site lighting utilities built to service the Orange County Justice Facility, and authorizing the Chair to sign; and approving the Service Agreement between Duke Energy and Orange County for Leased Site Lighting for the Orange County Justice Facility and authorizing the Purchasing and Central Services Director to sign. Chair Jacobs asked about the trees and Pam Jones said that this area was in a parking lot and there were no trees. A motion was made by Chair Jacobs, seconded by Commissioner Nelson to approve the dedication of Right-of-Way to Duke Energy as presented, contingent upon staff and County Attorney review, and authorize the Chair to sign on behalf of the Board; and approve the Service Agreement for site lighting; and authorize the Purchasing and Central Services Director to sign. Approval of Solid Waste Operations Center Change Order The Board considered approving a change order for soils remediation associated with construction of the Solid Waste Operations Center and authorizing the Manager to sign. Chair Jacobs said that somebody missed a chronic water saturated soil condition that will cost about $212,000 to remediate. He assumes that some professional was hired by Orange County to do a site evaluation. He asked why the taxpayers were paying for this instead of the contractor. Purchasing and Central Services Director Pam Jones said that the sub-surface soil had some problems and those were rectified. The only difference between this change order and the original was that it would have been included in the original bid. The costs assured by the architect would have still been in there. The costs are going to be comparable. To have this recognized as a site issue would not have saved $212,000. A motion was made by Chair Jacobs, seconded by Commissioner Foushee to approve a change order for soils remediation design changes in an amount not to exceed $212,742; and authorize the Manager to sign change orders authorizing the work. VOTE: UNANIMOUS dd. Orange Public Transportation Doing Business as The Orange Bus The Board considered authorizing Orange Public Transportation (OPT) to do business as "The Orange Bus" with the re-design of the web site, vehicle color change, and marketing towards this transition. Chair Jacobs said that it is unbearably precious to call this The Orange Bus. He likes OPT just fine, so he wanted the opportunity to vote against it.
