42 <br />In rendering this decision, the Board finds as follows: <br />1. That the applicant met their burden of proof by establishing by competent material and <br />substantial evidence that the proposed use was complaint with the provisions of the <br />Ordinance, <br />2. There was no competent material or substantial evidence presented to refute the <br />applicant's testimony or to show that the project did not comply with the requirements of <br />the Ordinance, <br />3. That the impact analysis, completed by Mr. Jeff Odell, did not establish substantial <br />evidence refuting the appraisal report, submitted by the applicant, completed by Mr. <br />Everett `Vic' Knight, during the June 24, 2008 Public Hearing. <br />NOW THEREFORE BE IT RESOLVED by the Board of Orange County <br />Commissioners that the Special Use Permit Lisa Wallace /Case Number A-2-08 / 711 Terry <br />Road is denied. <br />Upon motion of Commissioner ,seconded by Commissioner , <br />the foregoing resolution was adopted this the day of , 2008. <br />I, Donna S.
