Resolution of Denial <br />INFORMATION CONTACT: <br />Craig Benedict, 245-2592 <br />Michael Harvey, 245-2607 <br />PURPOSE: To receive final requested information and take action on a Class A Special Use <br />Permit (hereafter `SUP') application proposing the development of a private school at 711 Terry <br />Road (SR 1573). <br />BACKGROUND: On September 16, 2008, the Board of County Commissioners received a <br />final report on the aforementioned application proposing the development of a private school at <br />711 Terry Road (l"MBL 5.10..22 /PIN 0806-76-4683). <br />During the meeting, staff was asked to provide additional information concerning the project, <br />specifically: <br />1. A memo from the Fire Marshal indicating what State Fire Codes would require/mandate <br />in terms of an improved fire lane. Specifically, would a paved fire lane be required. <br />Staff Comment: According to Mike Tapp, the State Fire Codes do not require a paved <br />fire lane. The fire lane must be improved to: `support the imposed loads of fire apparatus <br />and shall be surfaced so as to provide all weather driving capabilities'. <br />2. A letter from the Caldwell Fire Department indicating that it can provide fire and <br />emergency response services to the development. <br />Staff Comment: According to the letter submitted by the Caldwell Fire Department, it <br />can provide fire and emergency services to the development so long as the applicant <br />provides for a secondary water source as detailed by the Orange County Fire Marshal. <br />Please refer to Attachments Three (3) and Four (4), respectively, for the breakdown of this <br />information. <br />
