The deed to these units shall be conveyed by the developer to the <br />Designated Entity prior to the issuance of a Certificate of Occupancy for <br />any of the dwelling units within District Two (2), <br />7. <br />S — SPECIFIC DEVELOPMENT GUIDELINES — DEVELOPMENT AND USE OF <br />DRIVE-THRU FACILITIES: <br />In addition to any and all applicable Federal, State, or local requirements, the <br />following specific standards shall govern the development and use of drive-thru <br />facilities for the Project: <br />I. There shall be a limit of five (5) total drive-thru facilities for the entire <br />Project broken down as follows: <br />a. There shall be a maximum of two (2) drive-thru facilities <br />utilized to support restaurant development within the Project, <br />b. The remaining three (3) drive-thru facilities shall be utilized <br />to support non-restaurant development(s) <br />2. No approved land use utilizing a drive-thru facility shall be located within <br />one hundred (100) feet of an exterior property line. This includes the <br />building, drive lane for the drive-thru, or parking facilities, <br />3. No menu board utilized as part of a drive-thru for a restaurant shall be <br />visible from an external roadway, <br />4. There shall be a minimum fifteen (15) foot vegetative strip planted along <br />the length of the roadway utilized by the drive-thru facility. This strip shall <br />be planted with sufficient vegetation for form a dense, opaque, buffer <br />planted to the following standard: <br />a. There shall be a continuous evergreen hedge planted along <br />the interior curb of the drive-thru lane that will have an initial <br />planting height of thirty (30) inches and achieve a height of <br />five (5) feet at maturity, <br />b. There shall be a second row of plantings behind the <br />continuous hedge line comprised of deciduous and <br />evergreen trees that will have an initial planting height of ten <br />(10) feet and achieve a height of at least thirty (30) feet at <br />maturity. <br />These trees shall be planted twenty (20) foot on center. <br />5. For land uses that utilize drive-thru facilities, parking area shall be reduced <br />by ten (10) percent to accommodate the additional traffic impact. <br />.91W <br />
