ATTACHMENT 2 — Statement of Consistency: <br />R <br />STATEMENT OF CONSISTENCY <br />OF THE <br />ORANGE COUNTY BOARD OF COUNTY COMMISSIONERS <br />PURSUANT TO NORTH CAROLINA GENERAL STATUTE 153A -341 <br />REGARDING A PLANNED DEVELOPMENT APPLICATION OF AMENDMENT TO <br />THE ORANGE COUNTY ZONING ATLAS FOR <br />BUCKHORN ROAD ASSOCIATES LLC <br />(PD- 01 -08) <br />Orange County has received and reviewed the application of Buckhorn Road Associates, LLC, <br />(the "Applicant ") to amend the Orange County Zoning Ordinance and Atlas to rezone four (4) <br />parcels of real property containing approximately one hundred and thirty (130) acres from <br />Economic Development District (I- 85Buckhorn Road EDD) and/or Rural Residential One (R -1) <br />to Buckhorn Village Planned Development — Economic Development District (BVPD -ED). The <br />parcels are identified more particularly in the application for amendment submitted by the <br />Applicant. <br />The Orange County Board of Commissioners has determined that the amendment requested if <br />approved will be consistent with Orange County's adopted comprehensive plan, and the Board <br />of Commissioners proposed action on the amendment applied for is reasonable and in the public <br />interest for the following reasons: <br />1) The proposed Amendment will allow for the development of a parcel of property <br />within the County consistent with existing overall policies and development <br />strategies embodied within the: <br />a. Orange County Economic Development Strategic Plan for Growth; <br />b. The Economic Development element of the Comprehensive Plan; and <br />c. The Efland - Mebane Small Area Plan. <br />2) That property(s) subject to the Zoning Atlas amendment are properly <br />situated and located to be served by existing major roads and mass transit <br />facilities. <br />3) That property(s) subject to the Zoning Atlas amendment are located in an <br />area where the necessary utility infrastructure is available to support the <br />proposed development. <br />Adopted by the Orange County Board of Commissioners this day of <br />2008. <br />Ayes: <br />Noes: <br />Donna Balser, Clerk to BOCC <br />
