ATTACHMENT4— Statement of Inconsistency: <br />STATEMENT OF CONSISTENCY <br />OF THE <br />ORANGE COUNTY BOARD OF COUNTY COMMISSIONERS STATUTE 153A-341 <br />PURSUANT TO DEVELOPMENT APPLICATION REGARDING A PLANNED ION OF AMENDMENT TO <br />THE ORANGE COUNTY ZONING ATLAS FOR <br />BUCKHORN ROAD ASSOCIATES LLC <br />(PD- 01 -08) <br />Orange County has received and reviewed the application of Buckhorn Road Associates, LLC, <br />(the "Applicant ") to amend the Orange County Zoning Ordinance and Atlas to rezone four (4) <br />parcels of real property containing approximately one hundred and thirty (13 0) acres from <br />Economic Development District (I- 85/Buckhorn Road EDD) and/or Rural Residential One (R -1) <br />to Buckhorn Village Planned Development — Economic Development District (BVPD -ED). The <br />parcels, are identified more particularly in the relevant application for amendment submitted by <br />the Applicant. <br />The Orange County Board of Commissioners has determined that the amendment requested if <br />approved will be inconsistent with Orange County's adopted comprehensive plan, and the Board <br />of Commissioners proposed action on the amendment applied for is not reasonable and not in the <br />public interest for the following reasons: <br />1) That pursuant to Section 20.3.2 (e) of the Orange County Zoning Ordinance, the <br />Board finds that the proposed Zoning Atlas amendment will not carry out the <br />intent and purpose of the adopted Comprehensive Plan or part thereof including, <br />but not limited to, the following: <br />a. The goals, policies, and objectives as detailed within the adopted Orange County <br />Comprehensive Plan including, but not limited to, the Economic Development <br />Element, and <br />2) That the proposed amendment is not consistent with the Orange County <br />Economic Development Strategic Plan for Growth in that the amendment <br />will not allow for the type or classification of jobs, as identified within the <br />Economic Development Strategic Plan. <br />3) That the Board finds that the proposed amendment will result in land uses <br />that are not similar to existing development as the existing land uses <br />surrounding the project are residential in nature. <br />4) That the Board finds that there is insufficient documentation, submitted by <br />the applicant, indicating that the project can be served through existing <br />
