October 7, 2008 <br />Orange County Commissioners and <br />Laura Blackmon, Orange County Manager <br />PO Box 8181 <br />Hillsborough NC 27278 <br />Subject: Final Conditions and Recommendations for Buckhorn Village <br />Dear Commissioners and County Manager: <br />On behalf of Buckhorn Road Associates, LLC, I have been directed to draft this letter concerning <br />the specific conditions discussed at the September 16, 2008 Orange County Commissioners <br />meeting and the Final Conditions of Approval provided on Wednesday September 24, 2008. <br />Buckhorn Road Associates is in agreement with all Conditions A -U with the exception of P and <br />S. The following are our responses to condition P and S as prepared. <br />CONDITION P — OPEN SPACE MANAGEMENT — PERIMETER LANDSCAPING <br />Buckhorn Road Associates offers a compromise of 50% breaks that include landscaped <br />berms and bio- retention areas that is a reduction from our previous 60% request. We <br />cannot stress enough the importance of this design solution. As stated in the previous <br />documentation and presentations, visibility of the retail center is a requirement of the <br />destination retailers earmarked for this development. Without this visibility, the project <br />is in jeopardy and would not be as revenue productive for all participants. <br />The Economic Development District Design Manual states the following "Limited <br />breaks in required interstate buffers mad, be allowed, but only if they are well designed <br />and provide either a scenic Vista or landscaped area. Landscaped berms, fences, and <br />walls, cis ivell cis .stornnvater detention por7ds or fbau71air7s, may be used in association <br />ivith such breaks, provided they are designed and located in harnionji lwith other site <br />.features and f actions. No more than one (1) break per lot shall be permitted, and the <br />break shall constitute no rn7ore than m,enly -five (25% of the interstate frontage. " <br />Our plan for thinning the existing vegetation and clearing and replanting the other <br />portions of the buffer (the 50% breaks), will theoretically return the buffer to a <br />vegetative state with the exception of the wet stormwater detention facilities. No <br />buildings or permanent structures are allowed within this buffer. <br />We have provided a conceptual rendering as requested depicting the 50% breaks <br />(requested as the compromise design solution #13) and the 25% breaks (allowed by the <br />ordinance).
