<br />Section 10.3 Multi-Family Dwelling Units <br />The Orange County Board of Adjustment shall be empowered <br />to issue Multi-Family Dwelling Unit Permits when it shall <br />make the Following findings. <br />10.3.1 That the minimum lot area required shall be <br />five acres. <br />10.3.1.1 That where sewage is to be disposed of by means <br />of a municipal sewerage system and the tract for <br />the project has at least 100 feet of right-of-way <br />access on a paved state maintained road, or on a <br />state maintained road to be paved within one year, <br />and where the planned enterance points conform to <br />the State Highway Driveway Manuel requirements, <br />Multi-Family units may be built to a density of <br />1000 square feet per dwelling unit in multiple <br />dwellings having two stories or less, provided <br />that no Dart of any building or parking area be <br />closer than 35 feet from all sides of the tract <br />that do not border on a state maintained road, <br />further provided that 300 square feet of usable <br />open space in addition to the area requirement be <br />provided per dwelling unit. The area requirement <br />can further reduced to 3000 square feet per dwelling <br />unit plus 3.00 square feet of usable open space if <br />six or more units are to be built, and the units are <br />to be two stories or less in height. <br />10.3.1.2 That where sewage is to be disposed of by means of <br />a municipal sewerage system and the tract for the <br />project has at least 100 feet of right-of-way access <br />on a paved state maintained road, or on a state <br />maintained road to be paved within one year, and <br />where the planned enterance paints conform to the <br />State Highway Driveway Manual requirements, units <br />may be built to a density of 4000 square feet per <br />dwelling unit in single story multiDle dwellings <br />provided that a planted buffer striD 100 feet wide <br />be reserved and maintained by the owners of the <br />project along all sides of the tract that do not <br />front on a paved state maintained road and that this <br />buffer area be kept free of parking. This area <br />requirement can be further reduced to 3000 square <br />feet per dwelling unit if six or more units are to <br />be built and the multiple dwelling units are to be <br />two or more stories in height. Under this section <br />of the ordinance the area requirement per dwelling <br />unit may be applied to the entire area of the tract, <br />including the buffer area, and no usable open space <br />is required. <br />10.3.2 That the minimum setback within which no building <br />shall be located shall be 35 feet from the highway <br />right-of-way line. On roads with no right-of-way <br />established, a 60 foot right-of-way will be assumed. <br />10.3.3 That paved access and two Daved off-street parking <br />spaces be provided for each dwelling unit and so <br />located that the space for each unit can be reached <br />without moving vehicles from another space. <br />10.3.4 That the water supply, unless a public water system, <br />shall be approved'in writing by the District Health <br />Officer. <br />10.3.5 Where six or more units are built, enclosed accessory <br />recreational areas may be constructed provided <br />such enclosed recreational areas are for the <br />exclusive use of the tenants of the Multi-Family <br />Droject and are operated on a non-profit basis. <br />The enclosed recreation areas may be considered part J <br />of the usable open stiace requirement and shall not <br />exceed 60 square feet in area for each dwelling unit <br />constructed.
