covenant or agreement hereof by County shall not be deemed a waiver of such <br />breach and no waiver by Landlord or any provision hereof shall be deemed to <br />have been made unless expressed in writing and signed by Landlord. No waiver <br />of any condition or legal right or remedy shall be implied by the failure of <br />Landlord to declare a forfeiture, or for any other reason, and no waiver of any <br />condition or covenant shall be valid unless it be in writing signed by Landlord. <br />No waiver by Landlord with respect to one or more tenant's or occupants of the <br />Shopping Center shall constitute a waiver in favor of any other tenant, nor shall <br />the waiver of a breach of any condition be claimed or pleaded to excuse a future <br />breach of the same condition or covenant. <br />(n) NOT USED <br />(o) With respect to any provision of this Lease which provides or infers, in <br />effect, that Landlord shall not unreasonably withhold or unreasonably delay its <br />consent or approval, County, in no event, shall be entitled to make, nor shall <br />County make, any claim against Landlord for money damages, and Tenant <br />hereby waives any claim or assertion by County that Landlord has unreasonably <br />withheld or unreasonably delayed any consent or approval, but County's sole <br />remedy shall be an action or proceeding to enforce any such provision of this <br />Lease, or for specific performance, injunction or declaratory judgment. <br />(p) DELETED <br />(q) NOT USED <br />(r) This Lease shall be recorded in the ofFce of the Orange County Register of <br />Deeds by County. <br />(s) NOT USED <br />(t) NOT USED <br />(u) DELETED <br />(v) DELETED <br />(w) DELETED. <br />(x) DELETED <br />(y) NOT USED <br />(z) If any term or provision of this Lease shall. be held invalid or unenforceable to <br />any extent, the remaining terms, conditions and covenants of this Lease shall not <br />be affected thereby and each of said terms, covenants and conditions shall be <br />valid and not be affected thereby and each of said terms, covenants and <br />conditions shall be valid and enforceable to the fullest extent permitted by law. <br />(aa) County hereby assumes responsibility for and shall take all reasonable <br />security measures for the Demised Premises. <br />29 <br />County of Orange, in North Carolina - Hillsborough Commons 07/02/08 <br />INITIAIS <br />RD <br />
