~q <br />External roadway improvements shall be bonded in their entirety (i.e. total cost for all <br />improvements deemed necessary to support the project and full build-out) prior to the <br />approval of any site plan, or the issuance of any permits authorizing earth disturbing <br />activities, by the County or any other governmental entity. <br />External roadway improvements shall be completed in accordance with the standards <br />ident~ed herein and any and all applicable NC DOT standards. <br />b. External sidewalk development. BRA shall post the necessary bonds and/or Letter(s) of <br />Credit for external sidewalk work associated with this project. <br />Any external sidewalk work proposed for location within NC DOT rights-of--way shall <br />require an encroachment agreement between BRA and NC DOT to allow for the <br />construction to commence. For all sidewalks located within the right-of--way, BRA shall <br />assume all maintenance responsibility until such time that the sidewalks are accepted by a <br />governmental entity for maintenance. <br />c. External and Internal Utility Infrastructure (Water/Sewer). Bonds and/or Letter(s) of <br />Credit shall be reviewed and approved by the City of Mebane and Orange County in <br />accordance with any and all applicable City of Mebane/Orange County policies and <br />standards. <br />External and Internal Utility Infrastructure relating to the installation of water/sewer lines <br />shall be completed in accordance with the City of Mebane's utility extension <br />policies/standards. <br />4. BRA shall develop and cause the review by the County Attorney's office and the City of Mebane, <br />all internal cross-easement agreements establishing vehicular and pedestrian access throughout <br />the property on proposed internal roadways, sidewalks, trails, etc. These easements shall not be <br />recorded until approved by all identified parties and prior to the approval of any site plan, or the <br />issuance of any permits authorizing earth disturbing activities, by the County or any other <br />governmental entity. <br />5. BRA shall develop and cause the review by the County Attorney's office and the City of Mebane <br />ownership agreements outlining BRA's responsibility for the perpetual upkeep and, maintenance <br />of all common areas, roadways, sidewallcs, trails, landscape areas, internal landscaped medians, <br />buffers, open space areas, utilities, and other similar apparatuses associated with the development <br />of the BVPD-ED project prior to the approval of any site plan, or the issuance of any permits <br />authorizing earth disturbing activities, by the County or any other governmental entity. <br />CONDITION: PROPOSED SY: DEVELOPER RESPONSE: ADMINISTRATION <br /> COMMENT: <br />Condition Three A Planning staff and the The Developer has no opposition to Approve the condition as <br />(3A Attorne 's office the condition written. <br />CONDIITON THREE B (3B) -PERMITTING AND LAND DISTURBING ACTIVITY: <br />(Recommended by Staff and the Attorney's office on September 8, 2008) <br />The permitting for any and all development within BVPD-ED shall be in accordance with: <br />1.
