4 <br />refutes Mr. Knight's findings and shows how the project will not `enhance or <br />maintain adjacent property values' as required under Section 8.2.1 (b) (2) of the <br />Ordinance <br />2. Local residents have expressed concern over the amount of traffic that will be accessing <br />Terry Road if the school is approved, <br />3. Local residents have indicated that they do not believe that the school is in harmony with <br />surrounding land uses, as required under Section 8.2.1 (b) (3) of the Ordinance. <br />As with all SUP applications the applicant bears the burden of establishing, through competent <br />material and substantial evidence, that all of the conditions associated with the approval of the <br />application have been met. <br />The Board of County Commissioners will make specific findings certifying compliance or non- <br />compliance with the specific rules, as established by the Ordinance, for this particular type of <br />land use in taking action on the SUP application. <br />Where the Board finds compliance with the general standards, specific rules, and all other <br />applicable regulations the application must be approved. <br />Where the Board does not find compliance, however, the application can be denied. It should <br />be noted, however, that competent evidence (i.e. expert testimony) needs to be provided <br />demonstrating that the project does not adhere to the required conditions, standards, or <br />findings as detailed within the Ordinance to support a denial. <br />FINANCIAL IMPACT: None <br />RECOMMENDATION(S): The Administration recommends that the Board: <br />1. Receive the recommendation of the Zoning Officer and the Planning Board, <br />2. Receive any and all additional information concerning this application, <br />3. Close the Public Hearing and begin deliberation, and <br />4. Schedule BOCC action on the SUP for the October 7, 2008 regular Board meeting. <br />
