Use of lots; setbacks, vegetation buffers and building envelopes. <br />Recognizing that this portion of Cabe Ford and Pleasant Green Road is zoned <br />"Agricultural-Residential," with existing farms as well as poultry; cattle and hog <br />operations adjacent to the proposed development, we hope that the placement of new <br />houses reflects sensitivity to these existing properties and activities. <br />REQUEST: <br />A. THAT APPLICANT STRIKE THE FOLLOWING LANGUAGE FROM <br />ARTICLE II (f) OF THE DELARATION FOR RESTRICTIVE COVENTNATS: <br />"The restrictions on any lots in the subdivision may be removed or waived only <br />by the written consent, duly acknowledged and recorded, of the Declarant." <br />THAT APPLICANT SUPPLY LANGUAGE INSURING THE ONGOING <br />INTEGRITY OF ALL VEGETATION BUFFERS, BUILDING ENVELOPES <br />AND SETBACKS. <br />B. THAT APPLICANT SUBMIT PROOF THAT, THROUGH COMPLIANCE <br />WITH APPROVED "GREEN" BUILDING PLAN, GENEROUS <br />VEGETATION BUFFERS AND BUILDING ENVELOPES, <br />ADEQUATE SPACE IS MAINTAINED BETWEEN NEW HOMES <br />AND EXISTING PROPERTY LINES; AND THAT DESTRUCTION OF <br />TREES AND WILDLIFE HABITAT WILL BE MINIMAL. <br />C. THAT APPLICANT MAXIMIZE SETBACKS WHERE EXISTING HOMES, <br />BARNS AND LIVESTOCK FACILITIES EXIST. <br />D. THAT APPLICANT, USING MASTER DEEDS AND THE HOMEOWNERS <br />ASSOCIATION CONTRACT, REQUIRE THAT FUTURE PROPERTY <br />OWNERS COMPLY WITH RESTRICTIONS INHERENT IN "VEGETATION <br />BUFFERS," "SETBACKS" AND "BUILDING ENVELOPES." AND THAT <br />THESE RESTRICTIONS NOT BE SET ASIDE FOR ANY REASON BY <br />FUTURE OWNERS/APPLICANTS <br />E. THAT DEEDS ON LOTS 1-5 AND 16-20 DISCLOSE THAT THESE LOTS <br />ABUT PROPERTY ON WHICH EXISTS LAWFUL AGRICULTURAL <br />ACTIVITY, INCLUDING THE RAISING OF CATTLE, HOGS AND <br />POULTRY. AND THAT NEW PROPERTY OWNERS BE MADE AWARE OF <br />THE POSSIBILITY OF ODORS, NOISESAND OTHER CONDITIONS IN <br />KEEPING WITH THESE ACTIVITIES. <br />
