5 <br />Certification of Adequate Public Schools (CAPS) <br />As per its letter, Orange County Schools pre-awarded a Certificate of Adequate Public <br />Schools (CAPS) for twenty (20) housing units. (CAPS dated May 13, 2008 is included in <br />Attachment 4.) <br />Fire Suppression <br />Applicant has proposed to install a water withdrawal facility (a half-acre wet pond with a <br />volume of around 150,000 cubic feet) for the purpose of emergency water for fire <br />suppression on-site. <br />Water -Sewer <br />• Individual well and septic disposal systems will serve all lots. <br />• The Orange County Environmental Health Department has determined that there <br />are twenty (20) acceptable private septic disposal fields and replacement fields. <br />(Please refer to Alan Clapp's email message of April 2008.) <br />Historic Preservation <br />• Care is given to the preservation of the cemetery located on Tract "A". <br />• The location of the proposed plat is referred to the State Archaeologist to determine <br />if other historic or archaeological assets are located on-site. (ERCD staff referred <br />this matter to the State Archaeologist on August 28th. No other historic or <br />archaeological assets were revealed in the State inventory.] <br />PLANNING STAFF ANALYSIS AND RECOMMENDATIONS: <br />1. The proposed development is compatible with the uses and densities suggested in the <br />Land Use Element of the Comprehensive Plan. <br />2. The proposed development complies with the Subdivision Regulations standards relating <br />to open space percentage and acres, the type of open space, roadway design, and <br />buffers. <br />3. The proposed development complies with the Zoning Ordinance standards regarding <br />minimum lot size, impervious cover, and density. <br />4. The applicant addressed the neighborhood concerns by reducing the number of lots from <br />thirty-three (33), as approved with the Concept Plan, to twenty (20) and providing turn <br />around capabilities for school buses. <br />5. The 4.73 acres (Tract "A") be dedicated to the County for the ultimate purpose of <br />conveying this parcel to the Eno River State Park. The instruments necessary to convey <br />the land to the Eno River Association and then to the Eno River State Park shall be <br />developed by the County Attorney's office. <br />Planning Staff recommends Approval. of the Preliminary Plat in accordance with: <br />• The attached Resolution of Approval, <br />• The 4.73-acre Tract "A" is accepted as public recreation land with the instrument to <br />convey the land to the Eno River State Park to be developed by the County Attorney's <br />office, Note: See Resolution of Approval item E.3j <br />• The $9,100 in-lieu-of parkland dedication fee be waived, and Note: See Resolution of <br />Approval item E.3j <br />• The "stub out" streets shall be included on the Preliminary Plat. Note: See Resolution of <br />Approval item 8.6j <br />
