4 <br />Thereafter, the Eno River Association will convey Tract "A" to the State of North <br />Carolina for inclusion in the Eno River State Park. <br />• Nine (9) acres of the 24.46 acres, or thirty-seven percent (37%), of the common open <br />space is in steep slopes, regulated floodplains, historic and archaeological sites, or a <br />natural area identified in the Inventory of Natural Areas and Wildlife Habitats and <br />would be considered Primary Conservation Areas under flexible development <br />regulations. Tract "A" (4.73 acres) will be dedicated as public recreation land and will <br />be accessible to the public through the Eno River State Park. <br />• Over sixty (60) percent of the open space cover is mature upland hardwoods, but not <br />in a regulated floodplain or on slopes overtwenty-five (25) percent. <br />• The Home Owners Association will own 19.73 acres of common open space. <br />• While not a requirement as the proposed subdivision is not aConservation -Cluster <br />Option of Flexible Development, less than half of the designated open space is <br />Primary Conservation Area. The proposed subdivision, nevertheless, meets the <br />standard because at least seventy-five (75) percent or fifteen (15) lots have direct <br />access to Primary or Secondary Conservation Areas, seventeen (17) or eighty-five <br />(85) percent of the proposed lots have direct access to Primary or Secondary <br />Conservation Areas, and the other three (3) lots are within three hundred (300) feet of <br />an access point. <br />• Developer provided a landscape plan showing primary and secondary tree protection <br />areas. <br />• 33.29% of the property is in common open space; thirty-seven (37) percent of which is <br />in areas that would be classified as Primary Conservation Area; and sixty-three (63) <br />percent of which is in areas that would be classified as Secondary Conservation Area if <br />developed under Flexible Development guidelines. <br />Total O en S ace Pro osed Pro osed in HOA Pro osed Public O en S ace <br />24.46 acres 19.73 acres 4.73 acres <br />COUNTY AGENCY REVIEWS: <br />Recreation: <br />Public Recreation Space: <br />• The property is located within the R8 -Chapel Hill District Park (as detailed on the <br />Recreation Service Area Boundaries Map), last updated in October 2004. <br />• No physical dedication of recreation space is warranted in this case as neither the <br />County Parks and Recreation Advisory Council nor the Environment and Resource <br />Conservation Department (ERCD) have identified recreation or conservation sites <br />within the subdivision. <br />• .The County Parks and Recreation Advisory Council recommends apayment in-lieu <br />option in the amount of $9,100 (20 lots times $455 per lot). <br />(Note: Public open space dedication of 4.73 acres was proposed after this review was <br />received. <br />Private Recreation Space: <br />• The County Parks and Recreation Advisory Council recommends the addition of a <br />private picnic shelter or playground to be placed in Open Space Tract "C". <br />• Acreage required for private, common, recreation open space to be set aside is <br />1.25 acres. 19.73 acres are proposed. <br />• The ERCD recommends that the proposed Open Space remain in private <br />ownership and be managed as undeveloped common land by the homeowners <br />association. <br />
