<br />At the regular meeting of the North Carolina State Board of Health at
<br />Pinehurst, North Carolina, on the 15th day of May, 1968, the roll call was as

<br />On the motion of Dr. Dawsey, which was duly seconded by Dr. Hiatt, the
<br />following resolutions were passed creating the Dogwood Acres Sanitary District
<br />in Orange County, North Carolina, sll in accordance with the provisions of
<br />Chapter 130, Article 12, General Statutes of North Carolina, as amended.
<br />BE IT RESOLVED: That the North Carolina State Board of Health, upon
<br />giving due consideration to the proposal to create the Dogwood Acres Sanitary
<br />District, Orange County, North Carolina, finds the following facts relating
<br />thereto, to-wit:
<br />(A) That the petition, containing the names of over fifty-one per cent
<br />(51%) of the resident freeholders requesing the creation of said
<br />proposed sanitary district as prescribed by law, was filed with the
<br />Board of Commissioners of Orange County, North Carolina, and duly
<br />approved by said Board.
<br />(B) The State Board of Health was duly notified through the Chairman
<br />of the Board of Commissioners of Orange-County; therefore, the
<br />State Health Director of the State of North Carolina and the
<br />Chairman of the Board of Commissioners of Orange County, mutually
<br />set the date and place for the joint public hearing to be held on
<br />Thursday, May 9, 1968, at 8 P.M. at the George Spransey residence
<br />located within the boundary lines of the proposed sanitary district.
<br />(C) Notice of the joint public hearing was duly given the general
<br />public by posting a notice on the bulletin board at the Orange
<br />County Courthouse and publishing the notice of the public hearing
<br />for four (4) successive weeks in the "Chapel Hill Weekly," a
<br />newspaper published in Chapel Rill, North Carolina, and having
<br />general circulation within the territory to be included in the
<br />proposed sanitary district.
<br />(D) That a joint public hearing was held by the Board of Commissioners
<br />of Orange County and representatives of the North Carolina State
<br />Board of Health, to-wit: Mr. M. 0: Caton, Regional Engineer, and
<br />Mr. Charles E. Rundgren, Assistant Regional Engineer, Sanitary
<br />Engineering Division, upom the question of creating the Dogwood
<br />Acres Sanitary District, Orange County. The joint public hearing
<br />having been held in accordance with the publication of said notice
<br />on Thursday, May 9, 1968, at 8 P.M. at the George Spransey residence
<br />located within the boundaries of the proposed sanitary district.
<br />(E) That at said joint public hearing opposition to the creation of the
<br />sanitary district was made by Mr. Leslie B. Cohen, a representative
<br />.of Southeastern Water and Utilities Company, which operates a water
<br />system in the area. According to information presented at the public
<br />hearing the people of the area desire water service other than now
<br />provided. Therefore, the Board of Commissioners of Orange County,
<br />and the representatives of the State Board of Health agree that
<br />the creation of the Dogwood Acres Sanitary District should be approved.
<br />The Board of Commissioners of Orange County adopted a resolution to
<br />that effect and requested that the State Board of Health create the
<br />District. Therefore, the representatives of the State Board of Health
<br />recommend to the State Board of Health at its next regular meeting
<br />that the proposed Dogwood Acres Sanitary District be approved and
<br />created.
<br />THEREFORE, BE IT RESOLVED FURTHER, that in the opinion of the State Board
<br />of Health of North Carolina, the territory described in said petition should be
<br />created as a sanitary district and it is for the best interest of the residents
<br />and inhabitants of the said proposed district for the purpose of preserving and
<br />promoting the public health the said proposed sanitary district be created, and
<br />that same be and is hereby created and established as a sanitary district, all in
<br />accordance with and pursuant to the provisions of Chapter 130, Article 12, General
<br />Statutes of North Carolina, as amended.
