To <br />provide greater water quality protection within Orange County. <br />BACKGROUND: The attached Soil Erosion and Sedimentation Control Ordinance amendments <br />conform to the amended Model Ordinance of the North Carolina Sedimentation Control <br />Commission. These changes are the result of legislative changes, the State's staff enforcement <br />experience and the recommendations of their attorneys. The amendments include changes such <br />as: <br />• increase to a $5000 per day civil penalty for violations, <br />• penalty assessment from the date of detection instead of the delivery date of the notice of <br />violation, <br />• extension of the plan approval expiration date from twelve months to eighteen months. <br />• land disturbing activity defined vs grading <br />• adhere to state and federal water quality laws <br />• plan denial if past fines are not paid <br />• inspectors' right to investigate <br />• restoration required after sediment control breach <br />Location <br />Lands within Orange County jurisdiction which presently includes Carrboro, Mebane and <br />Hillsborough (excludes county governmental projects). Chapel Hill has their own ordinance, but <br />inspections and enforcements are performed by Orange County. <br />
