MINUTES OF THE ORANGE COUNTY KKK 7 PAGE 105 <br />BOARD OF COMMISSIONERS <br />April 1, 1968 <br />The Board of Commissioners for the County of Orange, North Carolina, met in <br />regular session at the County Courthouse in Hillsborough, North Carolina, at 10 <br />o, clock A.M., on Monday, April.1, 1968. <br />Present: Chairman Harvey D. Bennett, and Commissioners, William C. Ray, <br />Henry S. Walker, Carl M. Smith and Ira A. Ward. <br />Absent: None <br />Minutes of the previous meetings were read and approved. <br />George Spransy of Dogwood Acres, Chapel Hill, North Carolina presented the <br />Orange County Board of Commissioners a petition, consisting of seven separate <br />petitions. Said petition contained the signatures of 121 freeholder residents <br />of the Dogwood Acres area and requested that a Sanitary District, known as the <br />Dogwood Acres Sanitary District, be established. <br />The County Administrator and the County Attorney advised the Board of <br />Commissioners that the petitioning resident freeholders constituted the necessary <br />percentage for the filing of said Sanitary District petition. The clerk to the <br />Board received the Sanitary District petition and same was filed. <br />Commissioner Ward introduced the following resolution which was read: <br />RESOLUTION RELATING TO THE CREATION OF <br />A SANITARY DISTRICT <br />BE IT RESOLVED by the Board of Commissioners for the County of Orange: <br />Section 1. That the Board of Commissioners has determined and does hereby <br />find and declare: <br />(a) That on April 1, 1968 a petition requesting the creation of a sanitary <br />district in the Dogwood Acres area of Orange County was received by the Board <br />of Commissioners for the County of Orange, a photostatic copy of which petition <br />is as follows: <br />NORTH CAROLINA <br />ORANGE COUNTY <br />PETITION FOR SANITARY DISTRICT <br />TO THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF ORANGE, NORTH CAROLINA: <br />We, the undersigned, constituting fifty-one percent or more of the resident <br />freeholders or fifty-one percent or more of the freeholders within the proposed <br />district hereinafter set out, do hereby petition the Board of County Commissioners <br />of the County of Orange to establish a sanitary district known as the Dogwood Acres <br />Sanitary District in complicance with Chapter 130, Article 12 of the General <br />Statutes of the State of North Carolina. The primary object of the sanitary district <br />is to obtain a supply of raw or filtered water for residents of the district for <br />the preservation and procreation of the public health and sanitary welfare within <br />the district. In addition to the aforesaid object, we request that the sanitary <br />district be vested with the powers outlined in North Carolina General Statute 130-128. <br />The proposed boundaries of the district are located entirely within Chapel. Hill <br />Township, Orange County, North Carolina, and are indicated on a man entitled <br />Dogwood Acres Sanitary District, prepared by Robert J. Ayers to which reference is <br />hereby made, which boundaries are described by metes and bounds as follows: <br />BEGINNING at a concrete monument located on the northern right-of way line of <br />Dogwood Drive, being State Road 1962, at the Southwest corner of Lot 64 of Dogwood <br />Acres Subdivision according to the map thereof recorded in Map Book 4, Page 113 <br />of the Orange County Register; running thence along the southern line of said Lot 64 <br />South 86 degrees 55 minutes East 278 feet to an iron pipe in the Southeastern <br />corner of said Lot 64 of Dogwood Acres Subdivision. Thence North 8 degrees 03 <br />minutes East 302 feet to an iron pipe located in the eastern corner of Lot 66 <br />Dogwood Acres Subdivision; thence North 32 degrees 55 minutes West 1162.5 feet to <br />an iron pipe in a rock pile in the line of Lot 74 of said Dogwood Acres Sub- <br />division; running thence North 77 degrees 15 minutes West 1514 feet to an iron <br />pine and pointers located in the Northwestern corner of Lot 87, Dogwood Acres <br />Subdivision; thence North 5 degrees 45 minutes East 200 feet to an iron pipe, a <br />corner of the Dogwood Acres Subdivision; thence North 64 degrees 53 minutes West <br />1552 feet to a point in the eastern right-of-way line of the Smith Level Road, <br />being State Road 1919, an iron located in the Northwest corner of Lot 1, Dogwood <br />Acres Subdivision; thence along the eastern right-of-way line of the Smith Level <br />Road South 10 degrees 15 minutes West 300 feet, South 4 degrees 30 minutes West <br />162.6 feet to a point, thence continuing along the right-of-way line of the Smith <br />Level. Road South 8 degrees 40 minutes East 777 feet to an iron pipe located in <br />the Southwestern corner of Lot 14, Dogwood Acres Subdivision; thence South 83 <br />
