zs <br />support when the agency provides documentation <br />which indicates the date of rEferral for such <br />legal action. <br />(2) The agency will report the final de~:ision of any <br />administrative hearing or civil proceeding to the <br />appropriate field office. If the agency does <br />nat provide this information within 30 days of the <br />final decision, the GTR, with the concurrence ~~f <br />the CAO, may recapture up to 50~ of the payment. <br />IV. SETTLEMENT CLOSDRE <br />If the complainant and respondent agree to settle the <br />complaint without the State or local agency's involvement, <br />the complainant may wish to withdraw the complaint. If the <br />complaint is resolved as a'result of the complainant's <br />withdrawal, the GTR must review the terms and conditions of <br />the settlement to determine whether the following criteria <br />are satisfied. <br />Withdrawals with Resolut;_on. A withdrawal with <br />resolution is based only on the ccmplainant's request <br />for withdrawal of a complaint because a resolution <br />has been agreed upon by the complainant and respondent. <br />1. Re uirements for Acce tance. The withdrawal <br />request must: <br />(a) be in writing; <br />(b) be signed by the complainant, or authorized <br />representative, and dated; <br />(c) identify the respondent to whom the <br />withdrawal applies; <br />(d) contain the HUD case number and the State or <br />local agency case number; <br />(e) explain the reason(s) complainant wishes to <br />withdraw the complaint (see also VI.3 of this <br />criteria; <br />(f) contain a statEment that there was no <br />coercion ar fear of retaliation from any <br />person (not just the respondent); and <br />(g) inform the complainant(s) and respondent(s) <br />that the complainant may refile the complaint <br />if .the terms of the settlement are not <br />satisfied where the discriminatory housing <br />
