CONCILIATION <br />During the period beginning with the filing of a complaint <br />and ending with the agency's reasonable cause determination <br />or dismissal of the complaint, the agency, to the extent <br />feasible,~will attempt to conciliate the complaint.* In <br />conciliating a complaint, agencies will attempt to achieve a <br />just resolution of the complaint and cbtain assurances that <br />the respondent will satisfactorily remedy any violations of <br />the rights of the aggrieved person and take such action as <br />will assure the elimination of discriminatory housing <br />practices or the prevention of their occurrences in the <br />future. <br />A. Successful Conciliation <br />1. Requirements for Acceptance. The conciliation <br />agreement must: <br />(a) be in writin with clearly defined terms and <br />conditions. It must be signed by the <br />complainant, respondent, and the State or <br />local agency -representative authorized to <br />enter into such agreements. <br />(b) include terms which remedy the unlawful <br />discrimination identified in the .complaint <br />and provide relief or compensation for the <br />complainant; <br />(c) contain provisions to adequately vindicate <br />the public interest, and prohibit recurring <br />future discriminatory housing practices by <br />the respondent; <br />(d) specifically state that the agreement <br />constitutes closure of the complaint filed <br />with RUD and the State or local agency; <br />(e) contain a provision stating that the <br />agreement shall bE made public unless the <br />complainant ~r,d respondent otherwise agree, <br />and the authorized representative of the <br />agency determines that disclosure is not <br />required to further the purposes of the State <br />or local agency; <br />(1) Examples of circumstances that may <br />result in partial disclosure or nondisclosure <br />of a conciliation agreement: <br />* These standards for conciliatior_ remain in effect even if <br />conciliation takes place after the agency's reasonable cause <br />determination. <br />
