Z3 <br />II. REASONABLE CAUSE OR NO REASONABLE CAUSE DETERMINATION <br />A. Re uirements for Acce Lance <br />The rationale behind a reasonable or no reasonable <br />cause finding is that the investigation has shown <br />sufficient or insufficient evidence to support <br />allegations raised. Such evidence is generally <br />established by determining whether (1) the data, <br />information, and analysis are sufficient to conclude <br />that the incident that occurred serves as the basis of <br />the allegations made by the complainant and/or <br />information disclosed in the course of the <br />investigation; (2) the unit sought was actually <br />available and on the market at the time of the alleged <br />occurrence; and (3) race, color, religion, sex, <br />handicap, familial status, or national origin was a <br />factor in the decision to deny or otherwise alter the <br />terms and conditions or privileges of the sale, rental <br />or financing of housing sought by the complainant. <br />These examples are not intended to be exhaustive. <br />B. Documentation Re fired: Th? case file must be <br />submitted to the GTR using the case file format <br />provided by HUD. The GTR will review the case file, <br />and at a minimum the case file must include: <br />1. The Final Investigative Report; <br />2. The Evidentiary Section; <br />3. A log/control sheet; and <br />4. Working papers. <br />C. Making the_ Determinati.cn <br />After examination of the above criteria, a reasonable <br />cause or no reasonable cause determination must be made <br />supported by the totalit of the facts obtained during <br />the investigation. <br />D. Documentation Re uired <br />The basis for the reasonable/no reasonable cause <br />determination must be well documented within the <br />context of the Final Investigative Report as specified <br />in Secticn I.E (4)-(7) as contained herein, and mailed <br />to HUD. A reasonable cause determination must include <br />tre date the case was referred to the agency's legal <br />.department for further action. <br />
