19 <br />whether this element is sufficient to file a <br />complaint,. intake staff should consider whether <br />the information as provided: <br />(a) informs the certified substantially equivalent <br />agency about the allegations that must be <br />investigated and defended; or <br />(b) contains language that could potentially <br />detract from or confuse the issues that need to be <br />addressed. <br />(c) Where it is determined that there is <br />insufficient information, the complainant(s) must <br />be notified immediately (by the 5th day after <br />receipt of the complaint) and informed, both <br />personally and in writing, what information must <br />be provided to constitute the filing of a <br />complaint. The complainant should be advised that <br />unless the required information is received, no <br />assistance can be provided. <br />(d) If the required information is not received no <br />Lurther action is necessary. <br />5. The complaint may be filed with the assistance of <br />an authorized representative of the person filing <br />the complaint. <br />The State or local agency is required to refer <br />complaints or provide information to HUD regarding <br />allegations which the agency receives involving a <br />practice which is not covered by the State or <br />local law, but is covered by the Federal Fair <br />Housing Act. (See Sections VII and VIII of~the <br />written agreement between the agency and H'JL.) <br />B <br />Dual=filed Com Taints - only dual-filed complaints are <br />considered for paymenti under the FHAP. <br />1. A dual-filed complaint is one that has been <br />docketed by both HUD and the agency. <br />2. Complaints filed first with a State or local <br />agency, and those received by HUD and subsequently <br />referred to a certified or interim certified <br />agency, are considered dual-filed with the agency <br />under its own law and with HUD under the Federal <br />Fair Housing Act. <br />3. In order to preserve the statutory period for <br />filing complaints, a complainant may provide <br />information to be contained in a complaint by <br />telephone, provided the State or local agency, or <br />
