MINUTES OF THE ORANGE COUNTY Bl'x 7 1AGE 103 <br />BOARD OF COMMISSIONERS <br />March 26, 1968 <br />The orange County Board of Commissioners met in adjourned session on Tuesday, <br />March 26, 1968 in the Court Room at the Courthouse in Hillsborough, North Carolina <br />at 8 P.M. <br />Members Present: Chairman Harvey Bennett, and Commissioners William C. Ray, <br />Carl M. Smith and Henry S. Walker. <br />Members Absent: Commissioner Ira A. Ward. <br />Members of the Orange County Planning Board were present. <br />This meeting was scheduled as the public hearing for the purpose of hearing the <br />recommended amendments to the Orange County Planning ordinance. <br />Chairman Bennett turned the chair over to Charles W. Johnston, Chairman of the <br />County Planning Board. Chairman Johnston conducted the public hearing on the proposed <br />amendments to the Orange County Planning Ordinance. You are hereby referred to the <br />minutes of the County Planning Board for the items of this public hearing. <br />Chairman Johnston turned the chair back to Chairman Bennett. <br />Chairman Bennett reconvened the meeting as a Board of Commissioners. <br />Chairman Bennett informed the Board that the negotiations with the Orange- <br />Alamance Water Systems, Inc. relative-to the enlargement of the water line from a <br />tan inch (101t) to a twelve inch (12") line between the water tank and the Eno Filter <br />Plant running westwardly along highway 70 had been completed. He stated further <br />that the Farmers Home Administration would not approve the loan from Orange County to <br />the Orange-Alamance Water Systems, Inc., however, they would approve a grant for the <br />completion of the project plans. <br />The following contract, as prepared by the County Attorney, was introduced and <br />approved by the Board and same was ordered recorded in the minutes of this meeting. <br />"THIS CONTRACT entered into this the 20th day of March, 1968, by and between the <br />COUNTY OF ORANGE, NORTH CAROLINA, acting by and through its duly constituted Board of <br />Commissioners, hereinafter referred to as the party of the first part and ORANGE- <br />ALAMANCE WATER CORPORATION, hereinafter referred to as party of the second part, <br />W I T N E s S E T H: <br />Whereas, the party of the second part has been organized and established under <br />the provisions of Chapter 55A of the General Statutes of North Carolina for the <br />purpose of constructing and operating a water supply distribution system serving water <br />users within an area described in plans and drawings now on file in the office of the <br />district, whioh district lies in the western part of Orange County and the eastern <br />part of Alemance County, North Carolina; and <br />Whereas, the party of the second part is now about to construct a water line from <br />Eno River in a general westerly direction toward the Town of Mebane, and has received <br />grant and loan from the United States of America acting by and through the Farmers <br />Home Administration of the United States Department of Agriculture, but said funds are <br />only sufficient to provide for a tan (10) inch water line from the pumping station at <br />or near Eno River to the standpipe which is proposed to be erected near U. S. Highway #70 <br />and near the plant of Perry's Farm Service. That the party of the second part has made <br />efforts to secure additional funds, but without avail, and now applies to Orange County <br />through its Board of County Commissioners to make available to said party of the second <br />part the sum of not exceeding Twenty-Seven Thousand Dollars ($27,000) for the sole and <br />express purpose of increasin.q the water line from the pumping station to the standpipe <br />above referred to from ten (10) inches to twelve (12) inches; and <br />Whereas, the Board of County Commissioners of Orange County have made a careful <br />and thorough investigation of this reouest and are of the unanimous opinion that it will <br />be not only to the best interest of the party of the second part that said line be <br />increased in size to twelve (12) inches, but that such action will inure to the benefit <br />of western Orange County and will provide adequate water facilities for industrial <br />development: <br />NOW, THEREFORE, it is agreed between the parties to this contract that the party <br />of the first part will make available to the party of the second part a sum not <br />exceeding Twenty-Seven Thousand Dollars ($27,000), which payment will be made not later <br />than the first day of June, 1968. <br />That as a part of the consideration for providing the funds herein specified, the <br />party of the second part agrees that it will accord to the party of the first part the <br />right and privilege of making one or more twelve (12) inch taps on any part or at any <br />location in the line of the party of the second part between Eno pumping station and the <br />Alamance County line and that said party of the second part will furnish water through <br />said twelve (12) inch taps at the reouest of the party of the first part, charging there- <br />for the regular rates as included in the schedule of rates of the party of the second <br />part.
