0119 <br />3 <br />The Zoning Officer has reviewed the application, the site plan and all supporting <br />documentation and has found that the application does comply with the specific <br />standards and required regulations concerning the modification. . <br />Provided the Planning Board and County Commissioners find in the affirmative <br />on the general standards, the Zoning Officer recommends approval of the request <br />for a Special Use Permit Modification subject to the following conditions: <br />All vegetation within the 100 foot buffer shall remain undisturbed. A waiver <br />of the 100 foot buffer shall be provided along the property line next to the <br />existing landfill. <br />2. Yard Waste, mulch and recyclables shall be kept in the designated area as <br />indicated on the site plan. Land within this designated area not in use shall be <br />seeded, repaired and maintained. <br />3. If any condition of this Special Use Permit shall be held invalid or void, then <br />this Special Use Permit shall be void in its entirety and of no effect. <br />No decision on the application is made by either the Planning Board or the Board <br />of Commissioners at the public hearing. Instead, the Planning Board has 3 <br />regularly scheduled meetings within which to prepare and submit a <br />recommendation to the Board of Commissioners or the Board of Commissioners <br />may direct the Planning Board to provide a recommendation by a date certain. If <br />the Planning Board fails to submit a recommendation within the required time, the <br />application shall be forwarded to the Board of Commissioners without a Planning <br />Board recommendation. <br />Administration Recommendation <br />The Administration recommends that the application be referred to the Planning <br />Board for a recommendation to be returned to the Board of Commissioners no <br />sooner than November 1, 2000. <br />
