telecommunications equipment, then the same restriction shall apply <br />except that the utility pole may be twenty (20) feet higher than the <br />adjacent pole heights. <br />e. Placement of an antenna and/or a dish on a utility pole shall only be on <br />poles owned or operated by a county franchisee or the county. <br />f. No commercial advertising shall be allowed on the antenna or dish. <br />g. The height restriction for utility poles within a special utility overlay <br />district shall lie limited to one hundred fifty (150,) feet. <br />(g) Fees. <br />Proposed (1) A filing fee in the amount of four thousand, dollars ($4,000.00) shall be submitted <br />to the planning and inspections department upon application for site development <br />approval. In addition; a biennial inspection fee of one thousand dollars <br />($1,000.00) is due the county at the time of inspection. <br />(2) Public land or right-of--way lease agreements will be established by separate <br />instrument: <br />Sec. XX-X1YX. Shared use of communication antennas. <br />Existing ~ (a) Notwithstanding any other provision of this article, to minimize adverse visual impacts <br />associated with the proliferation.and clustering of telecommunications towers, co- <br />location of facilities on existing or new towers shall be encouraged by: <br />Existing (1) Issuing permits to qualified shared facilities at locations where it appears there <br />may be more demand for towers than the property can reasonably accommodate; <br />or <br />Proposed (2) Giving preference to qualified shared. facilities aver other facilities in authorizing <br />use at particular locations.. <br />Proposed (3) Participation in the Master Telecommunications Plan.. <br />(b) For a facility to become a "qualified. shared facility", the facility owner must show that: <br />Existing (1) The facility is appropriately designed for sharing; and <br />Existing (2) The facility owner is prepared to offer adequate space an the facility to others on <br /> fair and reasonable; nondiscriminatory terms. <br />Existing (c) To satisfy requirertients of (b)(1) of this section; the facility owner must submit a written <br /> evaluation of the structural capacity of the tower. <br />Proposed (d) The requirements of (b)(1) of this section will be deemed to have been met when an <br /> affidavit attesting to the execution, by the tower owner/operator, of an agreement to <br /> authorize the collocation of antenna or other similar telecommunications device is <br /> presented. A,condition of any permit for a qualified shared facility shall be that.the <br /> permit shall be terminated, and the facility removed or turned over to the county, if the <br /> county finds that the facility owner is not complying with its obligations under this <br /> section and associated agreem'ents' with the county. The owner, shall have sixty (60) days <br /> to remedy the deficiency.. <br /> 8 <br />
