4 <br />ATTACHMENT 1 <br />STREAM BUFFER PROTECTION METHODS <br />METHOD 1 <br />1) Stream buffer on lot <br />This method was originally proposed by applicant. The following issues apply to the <br />stream buffer; <br />a) i's.~art of a minimum sized lot <br />b) does not offer secondary means of monitoring protection of area <br />c) permits disturbance of azea by well construction <br />d) severely limits the use of a minimum sized lot (40,000 SF) because the stream <br />buffer encumbers a large percentage of the lot and the remainder mazginally <br />permits the septic field, house, accessory structures, driveway and other front/side <br />yazd buffers. (See Lot 8 septic field sketch. In the case of lot 8, 75% of the lot <br />would be consumed by the conservation easement.) <br />e) the limited usable area increases the likelihood the encroachment of the stream <br />buffer may occur and restricts the use of the lot as compazed to others in the <br />subdivision and zoning district. <br />METHOD 2 <br />2) Stream buffer or lot with conservation easement <br />This method is a proposal by the applicant in response to concerns of the Apri14, <br />2000 Board of Commissioners meeting to enhance preservation and protection of <br />stream buffer. The following conditions apply; <br />a) is part of minimum sized lot <br />b) does offer secondary controls for monitoring by easement language <br />c) as written the easement permits disturbance of the stream buffer by allowing well <br />construction, however item d) should supplant this item c) <br />d) administration recommends: Lot 8 does not have enough unencumbered azea to <br />provide for a septic field, house, driveway and typical single family home <br />accessory structures. It is likely that the owner of lot 8 would want one or more <br />accessory structures further raising the likelihood that stream buffer <br />encroachments, especially as to structures typically constructed without building <br />permits, will occur. Therefore Lot 8 would need to be incorporated into Lot 7 <br />and/or 9, or both. Lot 8 is only marginally sized anyway and can only be used as a <br />lot if its well is located in the stream buffer. <br />(See preliminary sketch by Environmental Health of septic system layout of Lot $) <br />
